12. Investigate and follow-up on dangerous and vicious animal complaints, including but <br /> not limited to, initially determining the designation of animal as dangerous or vicious, <br /> as defined by appropriate ordinance; testifying at hearings; monitoring dangerous <br /> animal permits; investigating and citing owners for permit violations; impounding all <br /> dangerous and vicious animals posing an immediate threat to the public health and <br /> safety; euthanizing vicious animals; and performing annual inspections of <br /> residences maintaining dangerous animals. <br /> Under no condition shall a dangerous or vicious animal designation when <br /> determined in accordance with relevant County or City ordinance, placed on an <br /> animal by a law enforcement officer of any contract area as shown in Exhibit B to be <br /> overridden by Contractor. In cases where the contract area law enforcement officer <br /> is designating the animal as dangerous or vicious, Contractor's responsibility is <br /> limited to testifying as may be needed regarding prior history with animal and/or <br /> owner. <br /> 13. Investigate dog vs. person incidents at County and/or City or other approved off- <br /> leash dog areas including dog parks, beaches, public parks, etc., and if appropriate, <br /> designate animal as dangerous or vicious. <br /> 14. Assign animal control and/or humane officers to perform the functions specified <br /> throughout this Exhibit. Such officers shall conduct routine patrols except areas <br /> noted in Excluded Services 31.1-31.12; respond to complaints; investigate and <br /> perform rescues; comply with court subpoenas; impound dangerous, vicious, <br /> injured, and/or loose animals. <br /> 15. Employ sufficient resources to provide the level of service guaranteed in this <br /> Services Agreement for County and contract areas as shown in Exhibit B. <br /> 16. Field Enforcement Staffing & Services <br /> 16.1 Contractor shall staff its field services adequately to provide field <br /> enforcement services throughout the County as provided hereunder. Field <br /> Services enforcement shall be provided twenty-four (24) hours a day, seven <br /> (7) days a week as specified in this Exhibit C, Section 16. <br /> 16.2 Contractor's field services shall include enforcement of all local ordinances <br /> which are substantially similar to the County's Ordinance 6.04, 6.12, 6.16 <br /> and all related state laws pertaining to animals, except as otherwise noted in <br /> this Services Agreement. <br /> February 5,2015 -22- <br />
