In any case where a Planned Development Permit (PDP) has not been used <br /> within one ( 1 ) year from the date of granting by obtaining a building permit <br /> and beginning of construction of the improvements which are the subject of <br /> the permit, or by the establishment of the use which is the subject of the <br /> permit, the permit shall automatically terminate and be of no further effect; <br /> provided , however, the Planning Commission may extend this time once for <br /> an additional year upon written request of Applicant. Every PDP project for <br /> which construction has started shall terminate five (5) years from the date of <br /> granting if such construction has not been completed . <br /> 60. Pursuant to Section 66474. 9(b) of the California Government Code and/or <br /> Redwood City Municipal Code Section 1 . 54, Applicant shall defend, <br /> indemnify, and hold harmless the City, its agents, officers, and employees <br /> from any claim , action , or proceeding against the City or its agents, officers or <br /> employees, to attack, set aside, void, or annul an approval of the City, <br /> including but not limited to the Planning Commission, and the City's and <br /> Planning Commission's agents, officers or employees, concerning this <br /> subdivision . The City shall promptly notify Applicant of any such claim , action <br /> or proceeding and shall cooperate fully in the defense. <br /> 61 . No building or zoning permit shall be issued, and no use shall be established <br /> except in accordance with and subject to the terms and conditions outlined <br /> above, and in no case shall such permit be issued or use established prior to <br /> the final action on any appeals that may be filed within the appeal period . <br /> Any appeal must be received by the City Clerk no later than fifteen (15) <br /> calendar days after the date of the official action . As such , the Tentative Map, <br /> Condominium Permit, and Planned Development Permit shall become <br /> effective on the 16th day following the date of approval by the Planning <br /> Commission unless an appeal to said decision has been filed in accordance <br /> with the provisions stated above. <br /> 62. Recycled water facilities shall be provided and designed in accordance with <br /> Engineering Standards for dual plumbing, irrigation and other warranted uses <br /> pursuant to the Recycled Water Ordinance, Chapter 38, Article VIII of the <br /> Municipal Code. Prior to providing recycled water service, the City shall <br /> amend the recycled water service map to include the project area. <br /> 63 . The applicant shall hire an engineer licensed in California and experienced in <br /> the field of wastewater treatment to prepare a report pursuant to California <br /> Water Code section 13522.5 and in accordance with California Code of <br /> Regulations sections 60314 and 60323 (found within Title 22, Division 4, <br /> Chapter 3).
