WHEREAS, pursuant to Section 2 . 6 .2( B)( 1 ) of the DTPP (pg . 80) and the Draft
<br /> Disposition and Development Agreement ( Resolution No. _ for the Project), a Parking
<br /> In-Lieu payment for 115 spaces shall be paid to the City.
<br /> WHEREAS, on June 23 , 2015 , the Planning Commission considered an Initial
<br /> Study Checklist and its findings prepared by the City's Planning Division , the previously
<br /> certified Downtown Precise Plan Program Environmental Impact Report (State
<br /> Clearinghouse #2006052027 ) ("EIR"), the staff reports , oral and written , and testimony
<br /> and materials presented by all those wishing to be heard on this Project at the noticed
<br /> public hearing on this matter; and
<br /> WHEREAS, on June 23 , 2015 , pursuant to Section 2 . 0. 3-A of the DTPP (pg . 28),
<br /> the Planning Commission conducted a public hearing in accordance with all applicable
<br /> requirements of the Subdivision Map Act and the Redwood City Municipal Code, to
<br /> consider the Tentative Parcel Map Application TM2014-08, Downtown Planned
<br /> Community Permit Application DPC2014-07 , Parking In-Lieu Application , the Right-of-
<br /> Way Vacation (the " ROW Vacation") of a 10-foot strip of public street right-of-way (the
<br /> "Sliver Parcel") , all applicable requirements of the State Planning and Zoning Law and
<br /> the Downtown Precise Plan , and the recommendations of the AAC and HRAC; and
<br /> WHEREAS, the Planning Commission determined that the proposed Tentative
<br /> Parcel Map , Downtown Planned Community Permit, Parking In-Lieu Application , DDA,
<br /> Parking Agreement, and the ROW Vacation would further the purposes of and
<br /> appropriately implement the City of Redwood City General Plan , applicable provisions of
<br /> the Redwood City Municipal Code and Downtown Precise Plan , and the Project.
<br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS :
<br /> Section 1 . The Planning Commission finds that the above recitals are accurate and
<br /> constitute findings in this matter and , together with the Staff Report and the application
<br /> materials, including without limitation the Initial Study, development plans, and all other
<br /> documents, reports, studies, memoranda , maps, oral and written testimony, and materials
<br /> in the City's file for the applications and the Project, and all adopted City planning
<br /> documents relating to the Project and the property including the City's General Plan ,
<br /> Municipal Code , Downtown Precise Plan , Downtown Precise Plan EIR, other applicable
<br /> City laws and regulations, and all associated approved and certified environmental
<br /> documents, have together served as an adequate and appropriate evidentiary basis for
<br /> the findings and actions set forth in this Resolution .
<br /> Section 2 . Initial Study Checklist (" IS") : The Planning Commission finds that:
<br /> a . The IS was prepared in accordance with all legal requirements.
<br /> b . The Planning Commission has reviewed and analyzed the IS and other information
<br /> in the entire record and has considered the information contained therein , including
<br /> the written and oral comments received at the public hearing on the Project, prior
<br /> to acting upon or approving the Project.
<br /> c. Based on substantial evidence in the record , the proposed Project is within the
<br /> scope of the previously approved Downtown Precise Plan and is adequately
<br /> ATTY/RES0.3108/PC RESO RECOMMENDING APPROVAL OF TENTATIVE PARCEL MAP — 815 HAMILTON
