, �, <br /> prior to the construction and completion of necessary improvements <br /> listed in this subdivision agreement, including all streets, highw��s <br /> or public ways and public utility �facilities which are a part of, or <br /> appurtenant to, the abovementioned subdivision; and <br /> WHEREAS, Subdivider desir.es to enter into this agreement with <br /> City for. the construction and installation of said public improvements <br /> at the time specified in this agreement and City is willing to issue <br /> necessary and requested permits to Subdivider for the development of <br /> said real property described in Exhibit "A, " attached hereto, subject <br /> tb the public improvements being constructed in accordance with this <br /> agreement; <br /> NOW, 'I'HEREFORE ; <br /> It is hereby agreed to by the parties , as follows: <br /> ' � 1. The real property subject to this agreement is shown in' <br /> Exhibit "A, " attached hereto. <br /> 2 . Subdivider agrees to install and construct in accordance with <br /> the terms of this agreement the improvements described in Exhibit "B, " <br /> attached hereto. All worlc shall be constructed to the complete • <br /> satisfaction of the Department of Public Works. <br /> 3 . Subdivider agrees to cooperate with other property owners, <br /> the City and other public agencies to provide the public improvements <br /> set forth in Exhibit "B" of this agreement under a joint cooperative <br /> program including the formation of an assessment project under <br /> appropriate improvement and bond acts to secure the installation and <br /> construction of the improvements, if such program is undertaken by <br /> City. <br /> 4 . City may notify Subdivider at any time in writing to commence <br /> 2 <br />
