07/27/2015 neighborhood of the project, or be detrimental or injurious to property or improvements in the neighborhood of the project, or to the general welfare of the City, because the project has been found to be consistent with the community goals established in the City's General Plan and Zoning Ordinance; and c. The Project and improvements comply fully with all applicable standards of the DTPP; and d. The Project and improvements comply with all but nine (9) guidelines of the DTPP. The aspects of the Project which do not conform to the guidelines of the DTPP nonetheless adequately promote the overall intent of the DTPP. Section 5. Parking In-Lieu Application: The City Council finds that: a. The Project encourages employees and visitors to walk from off-site parking and transit facilities to the project site, thereby reducing automobile trips and parking demand, which would overall be beneficial to the Downtown community. Section 6. The Tentative Parcel Map, Downtown Planned Community Permit, Parking In-Lieu Application, Disposition and Development Agreement by and between the City and the Developer are hereby approved by the City Council based on the City Council's consideration and reliance on the Initial Study (IS) and Downtown Precise Plan EIR and in accordance with the plans, details, descriptions, and conditions of approval attached hereto and incorporated herein by reference.
