The Planning Commission has reviewed and analyzed the IS and other information <br /> in the entire record and has considered the information contained therein, including <br /> the written and oral comments received at the public hearing on the Project, prior <br /> to acting upon or approving the Project. <br /> c. Based on substantial evidence in the record, the proposed Project is within the <br /> scope of the previously approved Downtown Precise Plan and is adequately <br /> described in the previously certified Downtown Precise Plan Program EIR for <br /> purposes of CEQA. The mitigation measures and Statement of Overriding <br /> Considerations associated with certification of the Program EIR addresses the <br /> environmental effects of the Project. Accordingly, with the approval of this Project, <br /> all applicable mitigation measures and the Statement of Overriding Considerations <br /> are hereby reconfirmed and readopted. <br /> d. As set forth in CEQA Guidelines sections 15162 and 15168, the proposed Project <br /> will not result in any new environmental effects or require new mitigation measures <br /> beyond those identified in the Downtown Precise Plan Program EIR and adopted <br /> upon approval of the Downtown Precise Plan. No new environmental document is <br /> required. <br /> e. Pursuant to Guidelines section 15091(e), the documents and other materials that <br /> constitute the record of proceedings upon which the Planning Commission has <br /> based its decision are located in and may be obtained from the Office of the City <br /> Clerk at 1017 Middlefield Road, Redwood City, California. The City Clerk is the <br /> custodian of records for all matters before the City. <br /> Section 3. Tentative Parcel Map TM2014-08: The City Council finds that: <br /> a. The map, design, and improvements of the proposed subdivision are consistent <br /> with the City of Redwood City's General Plan, Municipal Code, Zoning Ordinance, <br /> Downtown Precise Plan, and all applicable subdivision improvements <br /> requirements; <br /> b. The site of the proposed subdivision is physically suited for the type and density of <br /> the proposed development; <br /> c. The design and proposed improvements are not likely to cause substantial <br /> environmental damage, or substantially and avoidably injure fish, wildlife or their <br /> habitat, or cause serious public health problems; and <br /> d. The design and proposed improvements of the proposed subdivision will not <br /> conflict with essential public easements for access through, or use of, property <br /> within the proposed subdivision. <br /> Section 4. Downtown Planned Community Permit DPC2014-07: The City Council <br /> finds that: <br /> a. The Project and improvements proposed by Downtown Planned Community <br /> permit DPC2014-07 are consistent with, conform to the intent of, and will <br /> appropriately implement the Downtown Precise Plan for the Project; and <br /> b. The establishment, maintenance and operation of the project and improvements <br /> proposed by Downtown Planned Community permit DPC2014-07 will not, under <br /> the circumstances of this particular case, be detrimental to the health, safety <br /> peace, morals, or general welfare of persons residing or working in the <br /> Page 3 of 20 <br /> ATTY/RES0.3115/CC RESO APPROVING TM,DPC,PARKING IN-LEU RESO.#15431 <br /> REV:07-17-15 VR MUFF#609 <br />
