Red Morton Community Park Playground Project; (304) <br /> REPORT: Senior Engineer Vorametsanti, July 15, 1996 <br /> In response to questions from Councilman Leipzig, City Attorney Schricker advised <br /> that the lowest bid on this project was defective as it did not include a bond; and the <br /> Council could reject all bids and go out to bid again. <br /> Engineering Manager Patterson advised that the lowest bidder apparently <br /> unintentionally submitted a defective bid, and the Engineering Department had followed <br /> the law by disqualifying that bid and awarding it to the next lowest bidder. <br /> City Attorney Schricker stated that if the Council chose to reject all bids, future bidders <br /> might be influenced by those actions and choose not to waste their time bidding. <br /> Additionally there were no guarantees as to how competitive the second bids would be <br /> once everyone knew the other's bids. City Attorney Schricker posed the question, "What <br /> does this do for the reputation of the City in the bidding sector?" <br /> Council Members discussed the $12,000 difference between the lowest two bids, grants <br /> the City had received for this project, the cost of rebidding and the possible 2-month delay <br /> a rebidding process would cause, and Councilman Claire added that the City tried this <br /> before and was sued. <br /> CONSENSUS: Mayor Hartnett determined it to be the consensus of the Council to <br /> postpone a decision on this matter until the next Council meeting. <br /> MINUTE ORDER NO. 96-176 <br /> ----------______n__________n______------------------------------______n______-------------------______n_____-_n_____- <br /> 4.
