Mayor Hartnett said "A compeIIing case has been made with respect to an individual - property, but there are obviously implications even arising from the presentation wherein the building of the roadway is assumed to somehow involve the possibility of additional building permits being issued. The implications of that have not been before us tonight. We have issues of slippage, seepage, sewer, safety and other issues that we need to ask further questions of our own staff as well as the applicant." Mayor Hartnett suggested that this item be continued to another Meeting. Councilman Ruskin agreed and said "at this hour I could not give this matter the kind of attention it merits.... MINUTE ORDER NO. 210 -------------------------------------------------------------------------------------------------------------- 4) Close public hearing; MIS: BUCHANILEIPZIG TO CLOSE THE PUBLIC HEARING AND CONTINUE THE ITEM TO THE NEXT REGULARLY SCHEDULED COUNCIL MEETING - (SEPTEMBER 16, 1996) DURING WHICH TIME THE COUNCIL CAN ASK QUESTIONS AND FOLLOW UP ITEMS, AND STAFF IS TO PROVIDE A REPORT, BEFORE THE MEETING, ON THE IMPLICATIONS OF THE PROPOSAL TO BUILD A 350 FEET LONG, 29 FEET WIDE ROAD ON LAUREL WAY In response to Senior PIarmer Passanisi's questions regarding the kind of report to provide to the Council, City Attorney Schricker advised there were legal implications. "It is a matter of advocacy. .. The Council has no legal authority to grant additional building permits, and I am concerned that the implication.... that by default you would be drawn into an approval that would come back later." Mayor Hartnett asked for "information on those specific lots where they have a connection with the road, and some general comments from the City Attorney as well."
