Report from the Legal Services Committee, Councilman Claire, Chairman; (205,304) <br /> Councilman Claire, Chairman of the Council Legal Services Committee presented the <br /> ~ report advising that the City Attorney was operating under a 5-year old contract with the <br /> City. Councilman Claire said the Committee was recommending the Basic Services <br /> armual retainer be increased from $352,800 to $390,000 and the hourly rate from $110 <br /> per hour to $120 per hour. <br /> Councilman Claire elaborated on comparisons of attorney's fees in other municipalities <br /> and said this recommendation was in line with good business practices. He said the <br /> proposed agreement included a six month termination clause applicable to both parties. <br /> Councilman Claire advised that many years ago the Council voted to make the City <br /> Attorney a contractual position rather than a City employee which had saved the City <br /> miIIions of dollars over the years. He described the excellent service the City received <br /> from Mr. Schricker and his staff and the great reputation City Attorney Schricker enjoyed <br /> in the municipal law field. He added that the recommendation included quarterly <br /> reviews rather than armual reviews, and even monthly reviews if necessary. <br /> Council Members advised their research on attorney's fees proved this proposal was <br /> very economical and expressed support for more meetings with the City Attorney's <br /> office. <br /> - Mayor Hartnett said his experience confirmed that the hourly rate was extremely <br /> reasonable and actually below market rate. He asked for clarification of "Outside <br /> Counsel" in Paragraph 9 of the Agreement and asked if authorization for those services <br /> were vested in the Council, both in Basic Services and Special Services. <br /> City Attorney Schricker confirmed that the Council would determine and authorize <br /> those services. He described this clause as being added by Council five years ago to <br /> cover those grievance procedures that involve the Council (over $10,000.) <br /> MIS: CLAIRE/LA BERGE.
