Report from the Legal Services Committee, Councilman Claire, Chairman; (205,304) Councilman Claire, Chairman of the Council Legal Services Committee presented the ~ report advising that the City Attorney was operating under a 5-year old contract with the City. Councilman Claire said the Committee was recommending the Basic Services armual retainer be increased from $352,800 to $390,000 and the hourly rate from $110 per hour to $120 per hour. Councilman Claire elaborated on comparisons of attorney's fees in other municipalities and said this recommendation was in line with good business practices. He said the proposed agreement included a six month termination clause applicable to both parties. Councilman Claire advised that many years ago the Council voted to make the City Attorney a contractual position rather than a City employee which had saved the City miIIions of dollars over the years. He described the excellent service the City received from Mr. Schricker and his staff and the great reputation City Attorney Schricker enjoyed in the municipal law field. He added that the recommendation included quarterly reviews rather than armual reviews, and even monthly reviews if necessary. Council Members advised their research on attorney's fees proved this proposal was very economical and expressed support for more meetings with the City Attorney's office. - Mayor Hartnett said his experience confirmed that the hourly rate was extremely reasonable and actually below market rate. He asked for clarification of "Outside Counsel" in Paragraph 9 of the Agreement and asked if authorization for those services were vested in the Council, both in Basic Services and Special Services. City Attorney Schricker confirmed that the Council would determine and authorize those services. He described this clause as being added by Council five years ago to cover those grievance procedures that involve the Council (over $10,000.) MIS: CLAIRE/LA BERGE. TITLE READ.
