REPORT
To the Honorable Mayor and City Council
From the City Manager

August 24, 2015
SUBJECT
Public Service Easement Deed granted by San Mateo Credit Union for the property at
350 Convention Way

RECOMMENDATION
By motion, approve a Publice Service Easement and authorize the City Manager to,
upon receipt of a signed Deed, accept a Public Service Easement Deed granted by San
Mateo Credit Union for the property at 350 Convention Way, and execute the Certificate
of Acceptance for such Deed.

BACKGROUND
In April, 2015, staff issued encroachment permit CP15-0009 for the final segment of a
24” water main crossing underneath U.S. Route 101, creating an additional connection
between the City’s water distribution networks on either side of the freeway. The City-
issued permit authorized work within the City’s right of way only. The work is required
as part of a Development Agreement between the City and R.C. Peninsula Park, LLC,
dated February 13, 2008, and the First Amendment to Development Agreement dated
September 27, 2010.

In carrying out the City’s responsibilities under the agreement and amendment, staff
obtained an encroachment permit from Caltrans for the portion of work within the
freeway right of way, and this permit required that approximately 100 feet of the pipeline
be constructed through private property located at 350 Convention Way.

ANALYSIS
City-owned utilities are typically found in public right of way and easements, where the
City has a right to install, use and maintain its utilities now and in the future. In order to
begin the portion of the project located on private property, staff requested that the San
Mateo Credit Union as property owner grant the city a Public Service Easement for the
installation, use and maintenance of the water main in perpetuity.

The property owner of 350 Convention Way, San Mateo Credit Union, can grant
property interests such as the proposed easement to the City through approval of its
Board at periodic Board meetings. Upon future favorable approval by the property
owner and receipt of an executed Deed, the Deed would be executed by the City and
6.1.F. - Page 1
