ATTACHMENT 1 <br />ATTY/RESO.3123/CC RESO AUTHORIZING THE AGR WITH BOE <br />REV: 08-10-15 PT <br />Page 1 of 2 <br />RESOLUTION NO.____ <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD <br />CITY AUTHORIZING THE CITY MANAGER AND THE CITY <br />ATTORNEY TO EXECUTE CERTAIN DOCUMENTS REQUIRED <br />BY THE BOARD OF EQUALIZATION TO COLLECT THE CITY’S <br />COMMUNICATION USERS TAX ON PREPAID WIRELESS <br />SERVICE <br />WHEREAS, pursuant to Communications User Tax Ordinance No. 2316 of <br />the City of Redwood City and the Local Prepaid Mobile Telephony Services <br />Collection Act, the City of Redwood City (the “City”) wishes to enter into a contract <br />with the State Board of Equalization, (the “BOE”) to perform all functions incident <br />to the administration and collection of the prepaid mobile telephony services <br />surcharge and local charges (Rev. & Tax. Code, § 42101.5) effective January 1, <br />2016; and <br />WHEREAS, the BOE requires that the City enter into a contract with the <br />BOE by September 1, 2015 if the City is to collect such monies in the first quarter <br />of 2016; and <br />WHEREAS, in order to enter into a contract with the BOE, the City must <br />certify the City’s Communications User Tax Ordinance rate and it’s applicability to <br />prepaid mobile telephony services; and <br />WHEREAS, the City must adopt a resolution authorizing certain persons <br />access to confidential information of the BOE that is only available to the BOE <br />regarding the proper collection and remittance of a local charge of the City, in the <br />event that the City has need for such confidential information. <br />NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated by reference as if fully set forth in their entirety. <br />Section 2. The City Council hereby authorizes the City Manager to enter <br />into an agreement with the BOE, as approved by the City Attorney. <br />6.3.B. - Page 4
