13 <br />behalf within a reasonable time after Bank receives such instruction. Unless <br />Company instructs Bank otherwise, Bank may in its sole discretion change <br />the address only for the Account(s) Company specifies or for all or some of <br />Company’s other Accounts with Bank. Bank may change Company’s address <br />of record if Bank receives an address change notice from the U.S. Postal <br />Service or if Bank receives information from a third party in the business of <br />providing correct address information that the address in Bank’s records no <br />longer corresponds to Company’s address. <br /> <br />Notices and Other Mail. <br />Any notice Company sends Bank will not be effective until Bank actually <br />receives it and has a reasonable opportunity to act on it. If there is more than <br />one Authorized Signer on Company’s Account, Bank may send statements <br />and other Account-Related Information to any one of them (unless <br />Company has otherwise instructed Bank in writing). Company assumes the <br />risk of loss in the mail. Any notice Bank sends Company will be effective <br />when mailed or otherwise made available to Company. <br /> <br />Contacting Company Regarding Servicing and/or Collections. <br />In order for Bank to service the Account or to collect any amounts Company <br />owes to Bank, Bank may from time to time make calls and/or send text <br />messages to Company at any telephone number(s) associated with <br />Company’s Account, including wireless telephone numbers that could result <br />in charges to Company. The manner in which these calls or text messages <br />are made to Company may include without limitation prerecorded/artificial <br />voice messages and/or an automatic telephone dialing system. In addition, <br />in order for Bank to service the Account or to collect any amounts Company <br />owes to Bank, Bank may send e-mails to Company at any e-mail address <br />Company provides to Bank. <br /> <br />Electronic Communications. <br />If Company provides Bank with an electronic address to which Bank may <br />send electronic communications, Company agrees that Bank may send to <br />Company by electronic communication any information that the laws <br />governing this Agreement require be sent to Company in writing, provided <br />such electronic communication does not violate the laws governing this <br />Agreement. “Electronic communication” means a message transmitted <br />electronically in a format that allows visual text or images to be displayed on <br />equipment such as a personal computer monitor. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />6.1.D. - Page 55
