REPORTER'S TRANSCRIPT OF PROCEEDINGS TAKEN 5-24-04

So, as an example, a 5,000 square foot
community serving market I think is an important
element. Whether the number of restaurants is --

you cap that at 5,000 or 10,000, I think we're

somewhat indifferent on that, as long as there's

some mechanism by which if we can't find substitute

retail, to the extent that the City is concerned

about competitiveness with the -- with the downtown

cinema project, that you give us some offset, so

that we're not held to a 25,000 square foot

standard and then find out that the only possible

uses that we could have built a remaining space

with would have been restaurant uses, and those are
I
,
now -- we're now preclude~ from doing that.
So if there's some mechanism that you would
propose that would allow us to have a flexible
number, we would certainly support that position.
COUNCIL MEMBER RUSKIN: All right. That's
fair.
MR. EVERETT: Mr. Mayor, why don't we let
the City Attorney read from the Precise Plan.

MR. BROWER: Mr. Mayor, members of the City

Council, I'm looking at the Precise Plan, on page

25, there is a discussion of nonlocal serving uses

which involve restaurant specialty shops and other

UCCELLI & ASSOCIATES 201
(650) 952-0774
