IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this _ day of_ <br /> jr /U , 201 )).-.(-"Effective Date") by and between by and between REDWOOD CITY <br /> JLF � 40N, LLC, a Delaware limited liability company ("Developer"), and the CITY OF <br /> REDWOOD CITY, a charter city and California municipal corporation ("City"), with reference <br /> to the following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting of <br /> approximately 1 .1 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B. On October 14, 2014, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 14-19, approving the Vesting Tentative Map for the 103 Wilson <br /> Street Project ("Project"), prepared by BKF Engineers and dated September 17, 2014 ("Tentative Map"), <br /> subject to certain conditions of approval ("Conditions"). <br /> C. The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the parcel map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled Jefferson and <br /> Franklin Improvement Plans, prepared by BKF Engineers and dated; , • 20, (the <br /> `Improvement Plans"), which, in addition to other improvements, provide for c am on- and off-site <br /> public improvements consisting of street and street light improvements, storm drain systems, domestic <br /> water systems and sanitary sewer systems for the Project (collectively, "Improvements").
