• <br /> 4 w> <br /> • <br /> which are subject to a Master Declaration ( "Declaration of <br /> Covenants, Conditions and Restrictions for Redwood Shores <br /> Owners Association" ) which provides, among other things, for an <br /> umbrella association ("Redwood Shores Owners Association") . <br /> The Master Declaration (recorded on the 13th day of February, <br /> 1981 , File No, 14180-AS, San Mateo County Records) provides <br /> that membership therein is required, is appurtenant to each <br /> unit , and occurs automatically upon transfer of title to a <br /> unit. <br /> ARTICLE IV <br /> MAINTENANCE AND ASSESSMENTS <br /> 4. 1 Creation of the Lien and Personal Obligation of <br /> :_' Assessments: The Declarant, for each unit owned <br /> J within the project, hereby covenants, and each owner of any <br /> unit by acceptance of a deed therefor, whether or not it shall <br /> be so expressed in such deed, is deemed to covenant and agree <br /> to pay to the Association: ( 1 ) annual assessments or charges, <br /> and (2) special assessments for purposes permitted herein, such <br /> assessments to be established and collected as hereinafter <br /> provided. The annual and special assessments, together ; r <br /> with interest, costs, and reasonable attorneys' fees, shall he <br /> a charge on the condominium and shall be a contiouing lien upon <br /> the condominium against which each such assessment is made, the <br /> lien to become effective upon recordation of a notice of <br /> assessment. Each such assessment, together with interest, <br /> costs, and reasonable attorneys' fees, shall also be the <br /> personal obligation of the person who was the owner of such <br /> condominium at the time when the assessment fell due. No owner <br /> of a condominium may exempt himself from liability for nis <br /> contribution towards the common expenses by waiver of the use <br /> or enjoyment of any of the common areas or by the abandonment <br /> of his condominium. <br /> 4. 2 Purpose of Assessments: The assessments levied <br /> by the Association shall be used exclusively to promote the <br /> recreation, health, safety, and welfare of all the residents in <br /> the entire project and for the improvement and maintenance of <br /> the common area for the common good of the project. <br /> 4.3 Annual Assessment: <br /> • A. From and after January 1 of the year immediately <br /> following the conveyance of the first unit to an owner, the <br /> annual assessment may be increased each year by not more than <br /> twenty percent (20%) above the maximum assessment for the <br /> previous year without a vote of the membership. <br /> 1 <br /> B. The Board may not, without the vote or <br /> written consent of a majority of the voting power of the <br /> Association residing in members other than the Declarant, <br />
