exceed a one ( 1 ) year term, shall provide for the right of the <br /> Association to terminate the same at the first annual meeting <br /> of the members of the Association, and to terminate the same <br /> for cause on thirty (30) days' written notice. or without cause <br /> or payment of a termination fee on ninety (90) days written <br /> notice. <br /> r D. Adoption of Rules: The Association or the <br /> Board may adopt reasonable rules not inconsistent with this <br /> Declaration relating to the use of the common area and all <br /> facilities thereon, and the conduct of owners and their tenants <br /> and quests with respect to the property and other owners. <br /> E. Access: For the purpose of performing the <br /> construction, maintenance or emergency repair for the benefit <br /> of the common area or the owners in common, the Association's <br /> agents or employees shall have the right, after reasonable <br /> sn notice (not less than 24 hours except in emergencies) to the <br /> owner thereof, to enter any Unit or to enter any portion of the <br /> common area at reasonable hours. Such entry shall be made with <br /> as little inconvenience to the owner as practicable and any <br /> damage caused thereby shall be repaired by the Board at the <br /> expense of the Association. <br /> F. Assessments, Liens and Fines: The Association <br /> shall have the power to levy and collect assessments in accordance <br /> with the provisions of Article IV hereof. The Association may <br /> impose fines or take disciplinary action against any owner for <br /> failure to pay assessments or for violation of any provision of <br /> the condominium documents. Penalties may include but are not <br /> limited to: fines, temporary suspension of voting rights, =' <br /> rights to the use of recreational facilities or other appropriate f <br /> discipline, provided that the accused member i3 given notice <br /> and the opportunity to be heard with respect to the alleged <br /> violations before a decision to impose discipline is made, as <br /> provided in Section 4. 10. <br /> G. Enforcement: The Association shall have the <br /> authority to enforce this Declaration as per Article VIII <br /> hereof. <br /> H. Acquisition and Disposition of Property: <br /> The Association shall have the power to acquire (by gib, <br /> purchase or otherwise) , own, hold, improve, build upon, operate, <br /> maintain, convey, sell, lease, transfer, or otherwise dispose <br /> of real or personal property in connection with the affairs of <br /> the Association. Any transfer of property shall he by document <br /> signed or approved by three-fourths (3/4 ) of the total voting <br /> power of the Association which shall include three-fourths ( 3/4 ) <br /> of the members other than Declarant, or where the two class <br /> voting structure is still in effect, shall include three-fourths <br /> ( 3/4 ) of the voting power of each class of members. <br /> I . Loans: The Association shall have the power <br /> to borrow money, and only with the assent (by vote or written <br /> } consent ) of three-fourths (3/4 ) of the total voting power of the <br /> ( Association including three-fourths ( 3/4 ) of the members other <br /> than Declarant, to mortgage, pledge, deed in trust, or hypothecate <br /> any or all of its real or personal property as, security for <br /> money borrowed or debts incurred. <br /> ; .( . r <br />
