The City's Stormwater M�nagement t?rdinance, Stormwater related <br /> guidelines, criteria and other written directions �"City Storrnwaier Regulati�ns") require that <br /> the stormwater trtieatment measure(s),as shawn c�n the approved Site Plan, be cx�ns�tructed <br /> �nt�mair�tained by the Property{7wner. <br /> AGREEMENT <br /> NOW, THEREF(�RE, in consideration r�f the benefit received hy the Prop�rfy�wner <br /> as a result ofi the Ci#y's app�oval of the Site Plan, the Property �wner hereby cavenanfs <br /> and agrees with the City as fiollows: <br /> 1. Gonstruction of Treatment Measures. The on-site �tormwater treatment <br /> rn�asure(s) shown an the Site Plan sMall be constructed by the Pro�rty Owner in stricfi <br /> accordance with the approved plans and specifications identified fc�r the Pro{�rty and any <br /> ather requirements thereto which have been appraved by the City in canformance with City <br /> Stormwater Regulations. <br /> 2. C3peration & Mainienance R�s�nsibilitv. This Agr��ment shall serve as the <br /> �igned s#atement by the P�operty Owner accepting responsibility #or c�peration and <br /> maintenance of stocmwa#er treatment measures as set farth irt this Agreem�nt until #he <br /> res�!onsibility is legally trans�err�d to another persr�n or en#ity. Befc�re the Prop�rty is <br /> legal[y transferred to another person or enfiity, the Property Owner shal[ pravide to the <br /> City at least one of the fatlowing: <br /> a. Written conditions in the sales or [ease agreement requiring the buyer or <br /> lessee to assume respansibility far operation and maintenance (U&M} ccansistent with <br /> this provision, which cartdititrns, in fhe case of purchase and sale agr�ements, shall be <br /> written to survive beyc�nd th$ close of escrow; or <br /> b. Written text in project conditions, cavenants and restrictions (CC&Rs) fQr <br /> residential prope�ties assigning 08�M responsibilities to the home owners association for <br /> O&M Qf the treatm�nt measures; ar <br /> c. Any ather legaily enforceable agreement or mechanisrn that assigns <br /> responsibility for the m�intenance of#reat�nent measures. <br /> 3. Maintenance of Tre�trnent Measures.
