REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />September 21, 2015 <br /> <br />SUBJECT <br />Parcel map and associated agreements for the development at 718 Canyon Road by <br />Ernst Development Corporation <br /> <br />RECOMMENDATION <br />1. By motion, rescind Minute Order 08-091. <br />2. By motion, approve the Parcel Map at 718 Canyon Road and accept on behalf of the <br />public all easements offered for dedication for public use. <br />3. By motion, approve and authorize the City Manager to execute an Improvement <br />Agreement with Ernst Development Corporation. <br />4. By motion, approve and authorize the City Manager to execute a Landscape <br />Maintenance Agreement with Ernst Development Corporation. <br />5. By motion, approve and authorize the City Manager to execute a Stormwater <br />Treatment Measures Maintenance Agreement with Ernst Development Corporation. <br /> <br />BACKGROUND <br />The project is a four-lot, single-family home development located at the corner of <br />Canyon Road and Bain Place. The development was initially submitted in 2005 and <br />substantial approval was obtained in 2008. However, the project applicant chose to <br />delay execution of this project during the economic downturn. The applicant recently <br />reinitiated the project and Architectural Permits were approved on August 14, 2015. <br /> <br />ANALYSIS <br />The Tentative Parcel Map for the subdivision at 718 Canyon Road was approved by the <br />Subdivision Committee on November 21, 2005, confirmed by the Planning Commission <br />on January 26, 2006, and extended by staff on January 22, 2008. On May 20, 2008, <br />Council approved Parcel Map 2006-01 and an associated Subdivision Agreement, but <br />neither the map nor the agreement were executed or recorded. Subsequent state <br />legislation automatically extended the Tentative Parcel Map for a total of seven <br />additional years so that the Tentative Parcel Map remains valid today. <br /> <br />Since the initial 2005 Planning Commission approval and 2008 Council action some <br />laws, regulations and practices have changed. The Parcel Map has been updated, and <br />the former Subdivision Agreement has been replaced by an Improvement Agreement <br />that is tied to the updated improvement plans, Subdivision Map Act, Redwood City <br />6.1.F. - Page 1
