Initial Study/Mitigated Negative Declaration (IS/MND): The City <br />Council finds that: <br /> <br />a. The IS/MND was prepared in accordance with all legal requirements. <br />b. Pursuant to CEQA Guidelines Sections 15072 and 15073, a Notice of <br />Intent to Adopt a Mitigated Negative Declaration was filed with the County <br />Clerk on July 29, 2015 and posted at various locations on the Project site; <br />and, a public review period of 20 days was provided. <br />c. The Planning Commission has reviewed the IS/MND and considered the <br />information contained therein prior to recommending approval on the <br />Project. <br />d. The sports lighting has been reviewed with respect to the California <br />Environmental Quality Act (CEQA). Pursuant to CEQA Guidelines Section <br />15074(a), the Planning Commission has considered the Initial <br />Study/Mitigated Negative Declaration for the project, which concluded that <br />no significant effects on the environment will result because the mitigation <br />and standard measures described in the Initial Study are included in the <br />project to reduce potential impacts to a less than significant level. <br />e. Based on the whole record, and as set forth in CEQA Guidelines Section <br />15074(b), there is no substantial evidence that the sports lighting will have <br />a significant effect on the environment and the Mitigated Negative <br />Declaration reflects the City’s independent judgment and analysis. <br />f. Pursuant to CEQA Guidelines Section 15074(c), the documents and other <br />materials that constitute the record of proceedings upon which the City <br />Council has based its decision are located in and may be obtained from <br />the Office of the City Clerk at 1017 Middlefield Road, Redwood City, <br />California. The City Clerk is the custodian of records for all matters before <br />the City. <br /> <br />Section 4. Approval of the Contract: the City Manager is authorized to <br />execute an Agreement with O.C. Jones & Sons, Inc. for the Red Morton Park Synthetic <br />Turf and Tennis Court Renovation Project in the amount of $4,441,700.00, and the City <br />Manager is authorized to execute an amendment increasing the agreement amount if <br />necessary, up to 10% of the amount awarded. <br /> <br />Section 5.
