<br />ATTY/RESO.3131/CC RESO RED MORTON <br />REV: 09-08-15 MLG <br />Page 2 of 3 <br />Project site in order to inform the public of the required 20 day public review and <br />comment period; and <br />WHEREAS, the required 20 day CEQA public comment period was open <br />between July 30, 2015 and August 18, 2015, and no public comment was received; and <br />WHEREAS, on August 18, 2015, the Planning Commission held a duly noticed <br />public hearing to review the proposed sports lighting installation and the Initial <br />Study/Mitigated Negative Declaration dated June 2015, as well as take in public <br />comment; and <br /> WHEREAS, the Planning Commission recommended approval of the sports <br />lighting project and adoption of its associated Initial Study/Mitigated Negative <br />Declaration; and <br /> WHEREAS, the City solicited construction bids for the Project in accordance with <br />City charter and ordinances; and <br /> WHEREAS, the lowest responsible bid was received was from O.C. Jones and <br />Sons, Inc. for their low bid of $4,441,700.00; and <br /> WHEREAS, on September 21, 2015 the City Council held a duly noticed public <br />hearing to consider the Project, the Initial Study/Mitigated Negative Declaration, and the <br />August 18, 2015 recommendations by the Planning Commission. <br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br />Section 1. The City Council finds that the above recitals are accurate and <br />constitute findings in this matter, and, together with the Staff Report, Initial <br />Study/Mitigated Negative Declaration, Planning Commission Resolution No. 15-17, and <br />all other Project-related documents on file with the City, has together served as an <br />adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />Resolution. <br /> <br />Section 2. Class I Categorical Exemption: The City Council finds that the <br />Project, with the exception of the sports lighting, is categorically exempt from the <br />California Environmental Quality Act pursuant to Section 15301, “Existing Facilities,” as <br />it involves the repair and maintenance of sports facilities within an existing City Park and <br />will not involve an expansion of the existing use. <br /> <br />8.A. - Page 6
