<br />As part of the Vesting Tentative Map application, the Applicant is requesting <br />modifications to the required street width and configuration. The analysis and findings <br />to support this request are discussed in detail in the attached Planning Commission <br />staff report. All other aspects of the proposed Vesting Tentative Map comply with the <br />City’s Subdivision Ordinance. <br /> <br />ALTERNATIVES <br />The City Council may choose to: <br />a. Approve an eight-lot project that further minimizes or fully eliminates the <br />requested PD setback modifications; <br />b. Approve the nine-lot subdivision design (April 2015) with proposed structures <br />and/or impervious surfaces (in addition to fencing) within the 25’ creek <br />protection setback area, with appropriate Use Permit findings <br /> <br />FISCAL IMPACT <br />Review of the proposed project is subject to the City’s Cost Recovery System, <br />therefore, direct costs during the entitlement process associated with staff and <br />consultant time are covered by an applicant deposit. Should the project be approved, <br />the Applicant will be required to pay all associated development impact fees, as <br />applicable and as established by ordinance. <br /> <br />ENVIRONMENTAL REVIEW <br />The City Council certified the First Amendment to the Draft Focused Finger Avenue <br />Nine-Lot Planned Development Project EIR (Final EIR) on September 10, 2012. The <br />certified EIR successfully withstood legal challenge and remains in effect. <br /> <br />Addendum No. 1 was prepared in March 2015 to identify the change in location for the <br />top of bank of Cordilleras Creek along the project site. The change in the top of bank <br />location as it is depicted on paper does not change the actual top of bank location as it <br />physically exists in the field. <br /> <br />Addendum No. 2 was prepared in August 2015 to identify the change in the project <br />design to an eight-lot residential subdivision with all impervious structures and ground <br />cover located outside of the 25’ creek protection setback (with the exception of lot line <br />fencing), reduced from the original nine-lot EIR project description. <br /> <br />Neither the change in the top of bank location nor the eight-lot Project design constitute <br />new information, any substantial increase in, or create any new environmental impacts <br />not identified within the certified EIR. Further, the City has determined that there are no <br />substantial changes proposed in the Project, or with respect to the circumstances under <br />which the Project will be undertaken, and there is no other relevant new information of <br />substantial importance which would require any major revisions in the certified EIR. <br />The amended eight-lot Project, along with the proposed conditions of approval, is <br />consistent with the certified EIR. <br /> <br />8.B. - Page 12
