While the site is adjacent to <br />Cordilleras Creek, the project proposes to remove existing structures and <br />impervious coverage near the creek top of bank and locate new construction <br />further away from the top of bank. <br /> <br />C. The design and proposed improvements are likely to cause substantial <br />environmental damage, or substantially and avoidably injure fish, wildlife or their <br />habitat, or cause serious public health problems. <br /> <br />The proposed project has been fully evaluated for potential environmental <br />impacts in the Finger Avenue Planned Development Environmental Impact <br />Report, certified by the City in 2012 and in the subsequent Addendum Nos. 1 and <br />2. The certified EIR provides mitigation measures required as part of any project <br />approvals, which lessen potential impacts to biological resources to a less than <br />significant level. The project will not cause substantial environmental damage or <br />injury to fish, wildlife, habitat, or cause public health problems. <br /> <br />D. The design or improvements of the proposed subdivision will conflict with <br />essential public easements for access through, or use of, property within the <br />proposed subdivision. <br /> <br />The proposed project does not conflict with any essential public access <br />easements. The project includes a privately-owned and maintained one-way <br />street that will be accessible to the public. <br /> <br />E. The reasons submitted for the granting of any exceptions applied for do not <br />comply with requirements for findings described in Section 30.69, and the <br />tentative map is deemed not workable without the granting of such exceptions. <br /> <br />The proposed project seeks modifications to street design criteria, not an <br />exception from any section of the Subdivision Ordinance. Therefore, the findings <br />noted in Section 30.69 do not apply. However, to the extent that the modification <br />is construed to require an exception, such exception complies with the <br />requirements for findings described in Section 30.69 as described below. The <br />project depends upon approval of the Planned Development Permit with <br />modifications and the modification to the street design criteria. <br /> <br />F. Such other findings of conflict with written public policy or with the public interest <br />as the Planning Commission may determine. <br /> <br />The proposed project will not conflict with any written public policy or with the <br />public interest as determined by the Planning Commission. <br />8.B. - Page 11
