Minimum number of parking spaces required and <br />design of parking spaces and parking lots. <br />Section 46.7(D) specifically states: "No Use Permit, otherwise required under the <br />applicable zoning district regulations, shall be required for uses or structures permitted <br />pursuant to an approved Planned Development Permit." <br />The 25foot Creek Setback for Buildings and Impervious Structures <br />Lots 1, 2, 3, and 4, as planned, all border (in the rear) upon Cordilleras Creek. The <br />other Lots do not, and do not appear to be of key concern for Petitioners. <br />Respondent points to 2AR 176 and 177. These are maps showing the existing <br />impervious areas" (like houses, cottages, concrete slabs, etc.) presently within the 25 -foot <br />creek setback (but are "grandfathered" in) versus the proposed construction which would <br />substantially reduce the amount of impervious areas within the Creek setback. <br />Specifically, the existing buildings in the areas designated as Lots 1-4 presently <br />encroach with impervious areas of 1303 square feet, 1478 square fee, 1213 square feet, and <br />496 square feet, respectively. Under the Finger Avenue Project plan, these existing <br />structures would be torn down and replaced with new homes and other impervious areas <br />which would encroach the creek setback to now 187 square feet, 348 square feet, 95 square <br />feet, and 87 square feet, respectively. Under the conditions set by Respondent in its <br />approval of the Project, the houses on Lots #3 and #4 would have to be moved or reduced <br />12 <br />8.B. - Page 71
