City’s Response: The historic resource preservation, height, setback and other <br />regulations address concerns with respects to views and view impacts. The City does <br />not have separate regulations to preserve views from private property, such as 620 <br />Jefferson Avenue. The City Council’s responsibility is to apply the existing regulations <br />for the benefit of the larger community. <br /> <br />viii. Summary: Staff Recommends Denial of the Appeals re: DTPP Permit. <br /> <br />For the reasons set forth above, the City Council has ample grounds to deny the <br />appeals with respect to the Planning Commission’s approval of the Downtown Planned <br />Development Permit. Appellants’ contentions fall short of showing that the Council must <br />grant the appeal and deny the Project based on non-compliance with the DTPP <br />standards and guidelines. <br /> <br />II. The City Appropriately Considered and Approved the Parking In-Lieu Fee <br />Request. <br /> <br />The Appellants contend that the City should not allow Applicant to pay an in-lieu parking <br />fee to satisfy a portion of the parking requirement ($2,950,000 in lieu of providing 118 of <br />the required 388 spaces). (See, e.g., Carr Appeal, p. 7; J&S Appeal, July 22, 2015 <br />letter, p. 1, and June 10, 2015 letter, pp. 25-28.) <br /> <br />Staff demonstrates below that the City has ample bases to deny the appeal on this <br />ground. <br /> <br />The DTPP and Section 30.2(C)(1) of the Zoning Ordinance provides that three parking <br />spaces shall be provided per 1,000 square feet of gross floor area for shared parking <br />which would be available to the public on nights, weekends and holidays. The Applicant <br />is proposing shared public parking on the Project site. With 129,235 square feet of <br />gross floor area, the minimum parking requirement is 388 spaces for shared parking. <br /> <br />The DTPP allows new development projects to apply to pay an in-lieu fee rather than <br />provide an associated number of parking spaces pursuant to Article 30.3 of the <br />Redwood City Zoning Ordinance. (DTPP, p. 80 [2.6.2(B)].) Section 30.3(C) of the <br />Zoning Ordinance authorizes the payment of an in-lieu fee to partially or fully satisfy off- <br />street parking requirements if the City finds one or more of the following conditions <br />applies: <br /> <br />1. It is infeasible to provide the required parking spaces on-site due to the <br />size, shape, or topography of the site, or other special circumstances <br />pertaining to the property; <br />7.A. - Page 15
