Page 3 of 21 <br />ATTY/RESO.3139/ CC RESO 601 MARSHALL DENYING APPEALS AND APPROVING TENTATIVE MAP, DOWNTOWN PLANNED <br />COMMUNITY PERMIT, AND PARKING IN LIEU FEE APPLICATION <br />REV: 9/24/15 PT <br />recommendation of the HRAC regarding the adjacent Historic Resources located at <br />611 Middlefield Road, 620 Jefferson Avenue and the historic San Mateo County <br />Courthouse at 2200 Broadway; and <br /> <br />WHEREAS, at the June 30, 2015 public hearing, the Commission determined <br />that the proposed Vesting Tentative Map, Downtown Planned Community Permit <br />including two guideline deviations, and Parking In-Lieu Fee Application would further the <br />purposes of and appropriately implement the City of Redwood City General Plan, <br />applicable provisions of the Redwood City Municipal Code, the City Zoning Ordinance <br />and Downtown Precise Plan, and the 601 Marshall Street Project, and approved the <br />Project; and <br /> <br />WHEREAS, three appeals were filed with the City during the 15-day appeal <br />period by 1) J&S Management c/o Tanya Gulesserian, Adams, Broadwell, Joseph & <br />Cardozo, 2) Richard and Sally Keyes, and 3) Geoffrey T. Carr (collectively, Appellants) <br />challenging the Planning Commission’s approval of the Project; and <br /> <br />WHEREAS, the matter was duly noticed for a de novo public hearing before the <br />City Council on September 28, 2015; and <br /> <br />WHEREAS, on September 28, 2015, the City Council conducted a duly noticed <br />de novo public hearing in accordance with all applicable requirements of the <br />Subdivision Map Act and the Redwood City Municipal Code, all applicable <br />requirements of the State Planning and Zoning Law, the City Zoning Ordinance and <br />the Downtown Precise Plan, to consider the appeal of the Project, and received and <br />considered oral and documentary evidence on the appeals and application; and <br /> <br />WHEREAS, the City Council considered the Initial Study checklist prepared by <br />the City's Planning Division and its findings, the previously certified Downtown <br />Precise Plan Program EIR (State Clearinghouse #2006052027), and the entire record <br />of the administrative proceedings regarding the adoption of the Downtown Precise <br />Plan (including without limitation the Mitigation, Monitoring and Reporting Plan <br />attached to Resolution No. 15086 adopted on January 24, 2011); and <br /> <br />WHEREAS, the City Council determined that the proposed Vesting Tentative <br />Map, Downtown Planned Community Permit including two guideline deviations, and <br />the Parking In-Lieu Fee Application would further the purposes of and appropriately <br />implement the City of Redwood City General Plan, the Downtown Precise Plan, and <br />applicable provisions of the Subdivision Map Act, the Redwood City Municipal Code <br />and Zoning Ordinance. <br />7.A. - Page 35
