Page 2 of 21 ATTY/RESO.3139/ CC RESO 601 MARSHALL DENYING APPEALS AND APPROVING TENTATIVE MAP, DOWNTOWN PLANNED COMMUNITY PERMIT, AND PARKING IN LIEU FEE APPLICATION REV: 9/24/15 PT WHEREAS, on May 5, 2015 the Architectural Advisory Committee (AAC) held a meeting to consider the proposed two deviations from the guidelines of the Downtown Precise Plan (DTPP), specifically pertaining to the “Tower” building disposition type, and voted 3-0 to recommend that the Planning Commission approve the deviation to allow tower floor areas over the 7,000 s.f., but denied the request for the reduced stepbacks of the tower levels; and WHEREAS, on May 26, 2015 the Architectural Advisory Committee (AAC) held a meeting to reconsider the proposed deviation from the guidelines of the Downtown Precise Plan (DTPP), specifically pertaining to stepbacks for the tower levels, and voted 4-0 to recommend that the Planning Commission approve the proposed deviation; and WHEREAS, the Planning Commission of the City of Redwood City ("Commission") is empowered by the Subdivision Ordinance of the Redwood City Municipal Code to act upon applications for Tentative Maps and by the Downtown Precise Plan and Zoning Ordinance to act upon applications for Downtown Planned Community (DPC) permits and Parking In-lieu Fee Applications; and WHEREAS, on June 30, 2015, the Commission conducted a public hearing, in accordance with all applicable requirements of the Subdivision Map Act and the Redwood City Municipal Code, to consider Vesting Tentative Map No. TM2014-10, and all applicable requirements of the State Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan to consider approval of Downtown Planned Community Permit Application No. DPC2014-05 and the Parking In-Lieu Fee Application; and WHEREAS, at the June 30, 2015 public hearing, the Commission considered an Initial Study checklist prepared by the City's Planning Division and its findings, the previously certified Downtown Precise Plan Program EIR (State Clearinghouse #2006052027), the staff reports, oral and written, and testimony and materials presented by all those wishing to be heard on this Project at the noticed public hearing on this matter; and WHEREAS, at the June 30, 2015 public hearing, pursuant to Section 2.0.3-A-2- a on page 30 of the DTPP, the Planning Commission considered and accepted the recommendation of the AAC regarding the Project's proposed deviations from the guidelines of the DTPP; and WHEREAS, at the June 30, 2015 public hearing, pursuant to Section 2.0.3-A-2- a on page 30 of the DTPP, the Planning Commission considered and accepted the 7.A. - Page 34
