<br />ATTY/DOCS-STAFF REPORTS/DRAFTS/DOCKTOWN STAFF REPORT STORAGE POLICY <br />REV: 09-17-15 PT <br />Page 1 of 2 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />September 28, 2015 <br /> <br />SUBJECT <br />Resolution of the Council of the City of Redwood City approving a removal and storage <br />policy for unauthorized watercraft at Docktown Marina and authorizing a fee for storage <br /> <br />RECOMMENDATION <br />Approve the Resolution of the Council of the City of Redwood City approving a policy for <br />removal and storage of unauthorized watercraft at Docktown Marina and authorizing a <br />fee for storage <br /> <br />BACKGROUND <br />The purpose of this staff report is to recommend a policy for addressing unauthorized <br />berthings at Docktown Marina. <br /> <br />On March 1, 2013, the City assumed management of Docktown Marina following the <br />decision of the long-term permittee to discontinue its Docktown operations. After <br />assuming management of Docktown, the City offered berthing licenses and rental <br />agreements to prior Marina users, including those living-aboard their “floating homes” or <br />other boats. Most Marina users signed agreements with the City. However, some <br />resisted entering into the agreements and/or stopped paying their rent. <br /> <br />The City pursues unlawful detainer actions against Marina users who do not sign a City <br />agreement or who fail to comply with the terms and conditions of an executed <br />agreement. After the City has successfully obtained a court judgment, some former <br />Marina users nonetheless leave their boats at Docktown without legal authorization. <br />Additionally, since the City took control of the Docktown, boats have occasionally <br />arrived at Docktown with no authorization whatsoever, and without making any contact <br />with the City. <br /> <br />ANALYSIS <br />The proposed policy would establish a $30.00 per day “unauthorized berthing” fee for <br />boats that are berthed without right or authorization. This fee does not create an <br />authorized berthing. Instead, the purpose of the fee is to ensure that unauthorized <br />boats incur a financial cost for use of Docktown. This will hopefully discourage <br />unauthorized berthings and incentivize the owners of unauthorized boats to move their <br />boats. The City can also use state law provisions to obtain a lien against a boat for the <br />6.3.B. - Page 1
