<br />ATTY/DOCS-STAFF REPORTS/DRAFTS/DOCKTOWN STAFF REPORT STORAGE POLICY <br />REV: 09-17-15 PT <br />Page 2 of 2 <br />unauthorized berthing fee, and--if need be-- can cause the sale for the boat to enforce <br />its lien. <br /> <br />Some of the boats illegally berthed at Docktown are physically difficult to move. <br />Therefore, the unauthorized berthing fee would not go into effect immediately, but would <br />instead go into effect forty-five (45) days after adoption of the Policy. Immediately upon <br />adoption, staff would widely publicize the adoption of the Policy, including posting the <br />Policy at Docktown, publishing the policy on the City web site, and, to the extent <br />possible, mailing the policy to the owner of each unauthorized boat and posting the <br />policy at the berthing site of each unauthorized boat. The purpose of this notification <br />campaign would be to give owners of unauthorized boats plenty of time to enter into an <br />agreement legitimizing their berthing or to arrange for the removal of their boat. <br /> <br />The Policy also authorizes the City to remove unauthorized boats to a dry dock storage <br />area or some other location, or to lock an unauthorized boat in place. Release of a <br />removed or locked-in-place boat could occur only once the owner paid the actual costs <br />of removal, plus outstanding unauthorized berthing fees and a $75 release fee. <br /> <br />ALTERNATIVES <br />Council may direct staff to reconsider other possible alternatives to present to Council at <br />a later date. <br /> <br />FISCAL IMPACT <br /> <br />Recover costs for storing unauthorized boats. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br />AARON AKNIN <br />INTERIM CITY MANAGER <br /> <br />ATTACHMENT <br />-Resolution - approving the policy <br />6.3.B. - Page 2
