Approve Task Order No.1 to the agreement for special legal services for the Redwood <br /> Shores Exterior Levee Improvement Project, and authorize an additional expenditure of <br /> $25,000 for additional work relating to the project's impacts on endangered species <br /> (Washburn, Briscoe and McCarthy); (304) <br /> REPORT: City Engineer, January 16, 1995 <br /> Councilwoman Steinfeld removed this item to respond to Mr. Ralph Noble's concerns, <br /> provided background on the hiring of Washburn, Briscoe and McCarthy, and asked staff <br /> for further information on this issue. <br /> City Attorney Schricker described the original agreement which incorporated some prior <br /> work, and advised that it was a policy decision by administrative staff to have outside <br /> counsel services on this project. <br /> City Manager Everett stated that he had enormous respect for Mr. Nobles and his <br /> sensitivity to the environmental community. City Manager Everett provided a detailed <br /> explanation of the City's attempts to obtain permits from the Corps of Engineers, stating <br /> that "staffis desperately trying to do what FEMA and the staff believes should be done. In <br /> fact we are required by law, by FEMA, to raise the height of our levees. We concur with <br /> those new requirements, and feel they should protect Redwood Shores. We have done that <br /> in, I think, the most environmentally sensitive way we can. We have worked with the <br /> Corps and spent huge....huge sums of money, and answered every question they have ever <br /> asked us. We have processed alternatives and spent engineering money and then the Corps <br /> has told us they really don't like that idea after all. I believe there are some internal <br /> problems within the Corps that is causing this not to be played on a fair playing field. We <br /> did not use attorneys for over three years. We have spent enormous sums of money and <br /> have neither a permit nor a promise for a permit, nor anything.
