The City Council grants the modifications set forth above and <br />conditionally approves the Planned Development Permit, Use Permit, and Vesting <br />Tentative Map for an eight lot residential development based on consideration and <br />reliance on the certified EIR and Addendum Nos. 1 and 2, and in accordance with the <br />plans, details and descriptions contained therein, contained in the Resolution certifying <br />said EIR and conditioned upon and subject to the Mitigation Monitoring and Reporting <br />Program, and subject to the Conditions of Approval listed below. <br /> <br />Section 10. Upon adoption, this Resolution shall supersede Resolution No. <br />15219 as it pertains to the Vesting Tentative Map for the project. <br /> <br />CONDITIONS OF APPROVAL: <br /> <br />1. Applicant shall implement and comply with all applicable project mitigation measures <br />described in the Final EIR and Mitigation, Monitoring Program (MMRP, attached as <br />Exhibit A to this Resolution) for the Finger Avenue Nine-Lot Planned Development <br />Project, adopted by the City Council by Resolution No. 15217 and on file with <br />Planning Services (EA-2006-03). All mitigation measures except for MM GEO-3 are <br />applicable to the Project. <br /> <br />2. All project conditions of approval and mitigation measures shall be printed on the <br />first page of any plans submitted to the Building Division for a building permit. <br /> <br />3. The project shall consist of nine new lots: eight residential lots and one common lot <br />for the roadway and shared guest parking. Other than property line fencing, there <br />shall be no structures or impervious surfaces located within the 25’ creek protection <br />setback. <br /> <br />4. None of the eight homes shall exceed 28 feet in height or 40% lot coverage. <br /> <br />5. The detached garage on Lot 7 shall be located a minimum of 6’ from the side and <br />rear lot lines. <br /> <br />6. With two covered parking spaces each, the proposed homes shall not have more <br />than four bedrooms. Any increase in bedrooms per lot shall require additional <br />covered parking consistent with the zoning ordinance and an amendment to the <br />Planned Development Permit. <br /> <br />7. Applicant shall ensure that the second story for the home on the lot immediately <br />adjacent to 90 Finger Avenue (Historic Finger Farmhouse) will be set back a minimum <br />of 10 feet from the common property boundary with 90 Finger Avenue, to allow dense, <br />vertical screen tree growth or large scale canopy trees for the purpose of providing a
