EIR does include an alternative analysis on site, the Sedway report refers to alternative sites. Vice Mayor Hartnett discussed the errata sheets being near the tail end of the process and City Attorney Schricker stated that it is part of the procedure to refine and respond further to clarify issues. In response to a question from Mayor Gasparini to Mr. Torrey about whether any of the 7 speakers raised any new issues at this meeting that were not responded to at some level and his response was no. The errata sheet cleared up some issues but did not change the basic conclusions and or back up analysis of the EIR. In response to a question from City Attorney Schricker, Christine Schneider responded that the errata sheet was prepared in March. Vice Mayor Hartnett emphasized that the appellants and their representatives did state a number of interesting points. The discussion in reference to incompatible land uses are well taken but he agrees with the conclusion of staff and the attorney that there needs to be a differentiation between policy issues from the EIR. The EIR does make reference to the incompatibilities and clearly states that it is certainly possible that if the project is built there will be pressure on the existing businesses there because of incompatible use. When it gets to the merit of the project this issue will be looked at very carefully. The EIR as a document does provide sufficient information within the guidelines. The document looks 99% OK from a legal point of view except for one issue regarding the incorporation of the Sedway study. The executive summary of the study should have been included in the report even though the report is incorporated by reference. 4) Close public hearing MIS: BUCHAN/SANFILIPO TO CLOSE THE PUBLIC HEARING AT 11 :08 P.M. CARRIED BY UNANIMOUS VOICE VOTE. 5) Council action MIS HARTNETT /LA BERGE to stay appeal and pending the stay remand the EIR to the Planning Commission for the purpose of including the executive summary of the Sedway study in the EIR. The EIR will then come back to Council on the appeal and that the EIR not be re-circulated. Councilman Sanfilipo requested further information on whether the executive summary was part of the entire report that was in the list of references in the EIR. Planning Director Patterson stated that the document was not included with the draft EIR it was incorporated by reference with copies in the Planning Department.
