She stated that there is an affordable housing issue in Redwood City <br /> and that the City should keep Docktown. <br /> Vice Mayor Foust asked the City Attorney to address the comment about Redwood <br /> Shores and conflict of interest. Ms. Thompson indicated that property interests have to <br /> be within 500 feet of a specific project to create a conflict of interest, which is not the <br /> case here. <br /> Dr. Bell stated that the Inner Harbor Specific Plan is currently going through an <br /> environmental review process and will likely conclude in June, after which it will follow <br /> the approval process until about December. He stated that a liveaboard community at <br /> Ferrari Pond is included in the Inner Harbor Plan, and if that were approved, then the <br /> process would take quite a long time. He noted that State Lands was involved with the <br /> Pete's Harbor process and the City asked State Lands to give input on this process and <br /> this is why they are here now. He stated that the ongoing annual cost to continue to <br /> manage Docktown Marina is $195,000. The cumutative cost of management of the <br /> Marina by the City is $1.5 million since April of 2013, including some one-time costs. <br /> He noted that the staff report did not require an environmental review for tonight's <br /> discussion, but a potential closure would include environmental review. <br /> Council Member Seybert asked if Precise Plans dictates usage. Dr. Bell stated that they <br /> would not necessarily indicate usage. He asked if the Precise Plan would supersede <br /> current law. Mr. Aknin, Assistant City Manager, stated that it would depend on how the <br /> plan addresses nonconforming uses. Council Member Seybert stated that the Inner <br /> Harbor Precise Plan can't override the State Lands Commission or other State Law. Mr. <br /> Aknin replied that is correct. <br /> Council Member Howard noted that there are historic landmarks on this site. Ms. <br /> Thompson stated that there is the water side and the City has control over that through <br /> the State Lands Grant, but the City does not own or control the land side except by a <br /> month-to-month arrangement with the land side owners. This includes the Yacht Club <br /> and the City has been paying for that access. <br /> Council Member Howard asked if the owner would need to be mindful of the historic <br /> landmarks. Mr. Aknin stated that there will be an analysis with the Inner Harbor Plan to <br /> determine whether or not that is actually a historical landmark. Council Member <br /> Howard asked if the easement is in jeopardy. Dr. Bell stated that it is not a long-term <br /> lease agreement and the owners have increased the fees. Council Member Howard <br /> asked what would happen if they eliminated the agreement. Dr. Bell stated that the City <br /> would have to find alternative ways for public access. <br /> Vice Mayor Foust asked about ownership and history of the area. Ms. Thompson <br /> stated that there were a number of parties and currently there are one or two owners <br /> that are represented by Mike Brown. Separately there is a developer that may have an <br /> interest in that property. Vice Mayor Foust stated that is the land side, because the City <br /> owns the water side. Ms. Thompson stated that this was not an issue until Mr. Ernhart <br /> walked away because he had control over both sides while he was here. There was a <br /> discussion about how the City controls the water side.
