Mr. Aknin and Dr. Bell stated that there is <br /> no ongoing long-term situation like that to the best of their knowledge. <br /> Vice Mayor Foust stated that she is interested in getting more clarification from State <br /> Lands, particularly when the Inner Harbor Plan is closer to completion. She stated that <br /> she is not interested in the City being an operator for the marina for a long period of <br /> time and asked if they could find another operator to take it over and do the necessary <br /> work. <br /> Ms. Thompson spoke about floating homes in Sausalito and Vallejo, indicating that the <br /> State Lands Commission feels that the factual and legal circumstances at Docktown are <br /> very different than Sausalito and Vallejo. <br /> Council Member Pierce asked what the land side owners could develop now. Mr. Aknin <br /> stated that there are not a lot of uses approved under Tidal Plane zoning. She asked <br /> about getting more information from State Lands. She asked if there could be a similar <br /> situation as Pete's Harbor. She noted that the waters around Docktown are not exactly <br /> navigable and that does not seem to fit the idea of the public trust. She asked if there is <br /> a way to include affordable housing in the Inner Harbor Plan. Mr. Aknin spoke about <br /> the difficulties of requiring affordable housing, but there are options. Ms. Thompson <br /> stated that the public trust is not just about boating, and elaborated on the public trust <br /> issue. <br /> Council Member Aguirre stated that she was surprised by how unhelpful the State <br /> Lands Commission letter is that was received today. She thanked the residents who <br /> have completed their paperwork for the City. Mr. Aknin stated that there have been <br /> ongoing conversations with the owners of Ferrari Pond and they are waiting for the <br /> Specific Plan to come out. <br /> Council Member Howard agreed with other Council Members about the lack of clarity <br /> from State Lands. She asked for something to do to buy some time for the Inner Harbor <br /> Plan. Dr. Bell noted that the staff s interactions with State Lands have been with the <br /> staff, not the policymakers, but staff can work on the best way to approach the <br /> policymakers with these concerns. <br /> Council Member Bain asked why the City is being asked about direct policy on this <br /> issue now. Dr. Bell replied that it is the threat of litigation and the staff has been <br /> working on this for two years. Council Member Bain stated that there are a number of <br /> issues that are not clear at this point, so there should not be an action to move forward <br /> with a relocation plan. He stated that the timeline is very unclear. He spoke about <br /> several points to keep Docktown including the strength of the community and their work <br /> keeping the creek clean, sea level rise, and the dearth of affordable housing. He asked <br /> staff to work with the residents to reduce costs, and agreed with Vice Mayor Foust <br /> about finding a new operator. <br /> Council Member Seybert stated that the policymakers are silent, so it seems they have <br /> not yet taken up the issue of changing the existing policy. He stated that it is worth <br /> going back to the policymakers at State Lands for more information. He spoke about <br /> the issues that the City and Docktown residents still need to work on.
