By motion, rescind Minute Order 15-143. <br /> 2. By motion, approve a Water Line Easement, and authorize the City Manager to, upon <br /> receipt of a signed Deed, accept a Water Line Easement Deed granted by the San <br /> Mateo Credit Union for the property at 350 Convention Way, execute the Certificate of <br /> Acceptance for such Deed, and modify the content of the Water Line Easement Deed <br /> as necessary to receive a signed Deed. <br /> BACKGROUND <br /> In April, 2015, staff issued encroachment permit CP15-0009 for the final segment of a <br /> 24" water main crossing underneath U.S. Route 101, creating an additional connection <br /> between the City's water distribution networks on either side of the freeway. The City- <br /> issued permit authorized work within the City's right of way only. The work is required <br /> as part of a Development Agreement between the City and R.C. Peninsula Park, LLC, <br /> dated February 13, 2008, and the First Amendment to Development Agreement dated <br /> September 27, 2010. <br /> In carrying out the City's responsibilities under the agreement and amendment, staff <br /> obtained an encroachment permit from Caltrans for the portion of work within the <br /> freeway right-of-way. This permit required that approximately 100 feet of the pipeline be <br /> constructed through private property located at 350 Convention Way. Staff continued its <br /> responsibilities under the agreement by approaching the property owner of 350 <br /> Convention Way, the San Mateo Credit Union. <br /> On August 24, 2015, City Council approved and authorized the City Manager to accept <br /> a Public Service Easement Deed upon future favorable approval by the property owner. <br /> At its regular board meeting on September 30, 2015, the property owner conditionally <br /> approved the granting of a revised form of easement, a Water Line Easement Deed. <br /> However, there were changes to the content of the easement deed based on <br /> Page 1 of 3 <br />
