Due to these changes the initial August Council action is <br /> recommended for rescission. <br /> ANALYSIS <br /> City-owned utilities are typically found in public right-of-way and easements, where the <br /> City has a right to install, use and maintain its utilities now and in the future. In order to <br /> begin the portion of the project located on private property, staff requested that the San <br /> Mateo Credit Union as property owner grant the necessary easements for the <br /> installation, use and maintenance of the water main. <br /> The easement deed presented for approval limits its purposes to the transmission, <br /> distribution and delivery of water by the City of Redwood City. This will meet the City's <br /> current and future needs as no other City utility or related installations are planned <br /> within the proposed easement area. The broader easement deed that Council <br /> previously approved was eventually turned down by the property owner. <br /> This updated easement deed also requires the City to indemnify the property owner for <br /> any liabilities relating to City's use of the easement area and expressly requires the City <br /> to properly maintain its facilities within the easement area. <br /> ALTERNATIVES <br /> Council may choose not to authorize acceptance of the Deed, which will prevent the <br /> construction of the final 100 feet of the pipeline through the private property located at <br /> 350 Convention Way. <br /> Council may choose not to accept the Water Line Easement and determine that the <br /> previously approved, broader Public Service Easement is still necessary. <br /> Council may also choose not to authorize the City Manager to accept the Deed until <br /> receipt of an executed Deed from the property owner, and may choose not to authorize <br /> the City Manager to modify the content of the easement, which may delay construction <br /> of the 24" water main. <br /> FISCAL IMPACT <br /> Prior to execution of the Deed, $2,500.00 will be transmitted to meet the property <br /> owner's condition of approval of the Deed. <br /> ENVIRONMENTAL REVIEW <br /> An Environmental Impact Report (EIR) was prepared for this area under the purview of <br /> the California Environmental Quality Act. The Marina Shores Village Project EIR was <br /> certified by the Redwood City Planning Commission in June 2003, with an addendum <br /> issued in October 2007 for the Peninsula Park Project, now known as One Marina. <br /> Page 2 of 3 <br />
