6.4.C. - Page 25 • Police Chief may suspend or revoke a Certificate if specified violations are found. • A Certificate may not be issued for a location if another Certificate for that location is currently under suspension, was revoked within the last year, or has outstanding administrative fines. • Suspensions and revocations of Certificates may be appealed to San Mateo County License Board. Decision of License Board is final with no further right to appeal or reconsideration. • No reapplication for Certificate within one year of revocation. • Massage businesses operating contrary to Ordinance are declared a public nuisance. • The proposed ordinance also exempts certain individuals or businesses including such as medical professionals, barbers, beauticians, hospitals, sports trainers, and massages at a single event such as a health fair The proposed ordinance, if adopted, will bring the City into compliance with current law and provide greater control over operations masquerading as legitimate massage establishments. ALTERNATIVES The City Council could choose not to introduce and adopt the ordinance or may seek changes to the ordinance. Any changes sought will need to be closely reviewed in order to ensure consistency with state law. FISCAL IMPACT The proposed ordinance is not anticipated to have a financial impact on the City's budget. The Redwood City Master Fee Schedule ensures the fee for registering a massage business in the City does not exceed the reasonable cost of staff time in reviewing a new application. ENVIRONMENTAL REVIEW This activity is not a project under CEQA as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or foreseeable physical change in the environment.
