(304); <br /> REPORT: City Engineer, October 9, 1995 <br /> In response to questions from Councilman Sanfilipo, candidate for Council, regarding health <br /> and safety factors, City Manager Everett advised that he and the Mayor had attended <br /> negotiations with the Corps of Engineers and the State Fish and Wildlife Agency, and advised <br /> that the City had been more than clear in what it was trying to do - to maintain the levee system <br /> to the degree of safety required by FEMA. City Manager Everett described certain past <br /> agendas and barriers to acquisition of the required permits, and advised that the City's national <br /> and respected expert, Mr. Huffman from Huffman and Associates, appeared to have broken the <br /> logjam and the regulatory review process seemed to be moving ahead on a positive track. In <br /> response to further questions, City Manager Everett described the physical changes the City is <br /> proposing for the levees due to slope, etc., the 6 inches to 2.5 feet the City had suggested in <br /> certain areas, and advised if two rare occurrences happened at the same time - a "100 year <br /> storm" at the time of a high tide - there might be some overage, but the levees would not be <br /> breached. City Manager Everett stated the levees were stable and the City was pressing <br /> forward to meet FEMA's requirements. <br /> In response to Councilman Sanfilipo's questions regarding liability issues, City Attorney <br /> Schricker stated "if worst came to worst and it was shown that the federal government abused <br /> its discretion and did not issue a permit, then we would expect that that entity would be <br /> answerable for any damages; and the City has done nothing by way of negligence or other <br /> culpable acts or omissions.
