<br /> Western Power Equipment Corp. <br /> TSH Architects <br /> Planning Director <br /> October 25, 1995 <br /> Page 2 <br /> Redwood City hereby finds, concludes and determines as follows: <br /> FINDINGS <br /> 1. On or about July 14, 1995 TSH Architects applied, on behalf of the <br /> owner of the Property and the operator of a proposed Gold's Gym facility <br /> (collectively, the "Applicant"), for a variance to the off-street parking <br /> requirements of the Zon. Ord. and for the issuance of a use permit to provide for <br /> the development and operation of a 30,000 square foot health club/gymnasium <br /> and for the operation of an adjacent 34,800 square foot warehouse building on <br /> the Property (the "Project"). <br /> 2. Following duly noticed public hearing on August 16, 1995, the Zoning <br /> Administrator granted the variance and use permit subject to certain conditions. <br /> Appellant filed timely appeal to the Zoning Administrator's decisions. <br /> 3. Duly noticed public hearing was held on the appeal by this Council on <br /> September 18, 1995, which hearing was closed on said date. The matter was <br /> continued to the regular Council meeting of October 9, 1995 for further <br /> consideration and submittal of additional information. <br /> 4. Warehouses, and the operation and maintenance thereof, are <br /> permitted structures and uses within the "IR" Zoning District (Zon. Ord. §17.2b). <br /> Based upon information submitted by the Applicant to the Zoning Administrator, <br /> the warehouse portion of the Project would require a minimum of 35 off-street <br /> parking spaces (Zon. Ord. §30.2.3b). <br /> 5. Health club/gymnasiums are not expressly permitted or conditionally <br /> permitted uses within the IR Zoning District (Zon. Ord. §17.4). Under such <br /> circumstances, the Zoning Administrator is authorized to determine, after a <br /> public hearing, whether a proposed use, not expressly designated as a <br /> permitted or conditional use, is of the same general character as the uses <br /> permitted within the IR Zoning District and is not inconsistent with the purposes <br /> of the IR Zoning District regulations (Zon. Ord. §17.4h.). Exercising such <br /> authority, the Zoning Administrator, in the instant proceedings, determined that <br /> the proposed health club/gymnasium would be of the same general character as <br /> the uses permitted under Article 17 of the Zon. Ord., and would not be <br /> inconsistent with the purposes of said Article (id.). Accordingly, the Zoning <br /> Administrator determined that a use permit may be issued for such use (id.). <br /> ,- - <br />
