The Property is traversed by the Jefferson Branch of Redwood Creek <br /> which severs roughly one-fourth of the area of the Property adjacent to the rear <br /> lot lines of the properties fronting on Hudson Street, from the roughly three- <br /> fourths of the area of the Property fronting on Iris Street. The Project includes <br /> spanning the creek, the construction of a box culvert to "1 DO-year flood" <br /> standards, landscaping, and the installation of 7 foot high fencing along the rear <br /> and side property lines, with specified set-backs. <br /> 3. On July 18, 1995, Appellant timely filed his appeal, per letter of even <br /> date (the "Appeal Letter") to the issuance of the use permit. <br /> 4. In addition to Appellant, numerous neighbors objected the issuance of <br /> the use permit, and voiced their objections at the hearing held by the Zoning <br /> Administrator. Upon stipulation, Applicant and Appellant, and other interested <br /> persons, submitted their dispute to a mediation process which concluded, <br /> without resolution of the dispute, on or about June 26, 1995. Under the terms of <br /> the use permit, it became effective as of that date. <br /> 5. At the proceedings held by this Council on October 9, 1995, Appellant <br /> requested, and Applicant concurred, that proceedings on the appeal be deferred <br /> for approximately three weeks to allow the congregations of the church the <br /> opportunity to approve a then-pending proposed compromise. Said <br /> congregations did not approve the compromise, and the hearing on the appeal <br /> was concluded on October 30, 1995. <br /> 6. Although used as a church facility, the property, and the improvements <br /> thereon, present a residential appearance. A small amount of off-street parking <br /> is provided on the Property, but the majority of the congregations attending the <br /> services use on-street parking. <br /> 7. Some three congregations, comprised of approximately 77, 66, and <br /> 100 persons, respectively, attend meetings/services on the Property, weekly, <br /> during evening hours on Tuesdays-Thursdays, and during the daytime on <br /> Sundays. The intensity of the on-street parking associated with said religious <br /> meetings has given rise to complaints of residents in the vicinity of the property. <br /> 8. Churches are a "quasi public" use (Zon. Ord. § 283). Under the <br /> applicable R-2 Zoning District Regulations, quasi public uses are conditional <br /> uses, requiring the issuance of a use permit (Zon. Ord. § 6.4). <br /> 9. The use of the Property for church purposes pre-dates the adoption of <br /> the Zon. Ord., and such use continues as a lawful use (Zon. Ord. § 42.10). <br /> -' - <br />
