1 <br /> <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />November 16, 2015 <br /> <br />SUBJECT <br />Appeals by three parties - Geoffrey T. Carr, Richard and Sally Keyes, and J&S <br />Management - of Planning Commission Resolution No. 15-12 for 601 Marshall Street <br />pursuant to the City of Redwood City's Downtown Precise Plan and Subdivision <br />Ordinance <br /> <br />RECOMMENDATION <br />Hold a Public Hearing and Adopt a Resolution denying the appeals and approving a <br />reduced eight-story, 105' tall proposal, including a Vesting Tentative Map, Downtown <br />Planned Community Permit including one guideline deviation, and Parking In-Lieu Fee, <br />based on the findings and subject to the conditions of approval contained therein, and <br />upon consideration of the revised Initial Study Checklist demonstrating compliance with <br />the Downtown Precise Plan Environmental Impact Report (EIR) as certified on January <br />24, 2011 <br /> <br />BACKGROUND <br />On June 30, 2015 the Planning Commission approved a new, 9-story office building on <br />the subject property, 601 Marshall Street. Following the Planning Commission hearing, <br />three separate parties appealed the approval to the City Council. An appeal hearing <br />was held on September 28, 2015 (The staff report, including City staff’s responses to <br />the appeals, can be accessed via the link provided at the end of this report and is <br />incorporated by reference into this report.) <br /> <br />The Applicant had entered into settlement agreements with all three Appellants shortly <br />before the Council hearing. As a result of the settlement agreements, the applicant <br />submitted a smaller, 8-story proposal for Council consideration the week before the <br />Council meeting. While the Council did give direction that they preferred the 8-story <br />proposal on September 28th, the Council continued the public hearing to give staff and <br />the Council time to review the proposed settlement agreements. The Council also <br />requested additional information pertaining to the project’s compliance with the DTPP, <br />and additional Downtown traffic and parking analysis. <br /> <br />ANALYSIS <br />A 9-story project was approved by the Planning Commission on June 30, 2015. The <br />details of this project as they relate to the DTPP are shown in Tables 1 and 2 below. <br /> <br />7.C. - Page 1
