<br /> 1 --- <br /> R E P 0 R T TO THE HONORABLE <br /> MAYOR AND CITY COUNCIL <br /> NOM THE CITY MANAGER <br /> DATE: November 29, 1993 <br /> -SUBJECT: - Findings and Recommendations of the Zoning Administrator <br /> pursuant to Section 42.9 of the Zoning Ordinance regarding <br /> Revocation Procedures to modify and/or impose new conditions <br /> in lieu of Taco Bell's Use Permit at 910 Woodside Road (continued <br /> from November 1, 1993). <br /> EXE <br /> RECOMMENDATION: That the City Council hear additional testimony, close <br /> the public hearing, review the findings and recommendations of the <br /> Zoning Administrator and impose new conditions to Taco Bell's Use <br /> Permit (Alternative 2). <br /> BACKGROUND: On November 1, 1993, the City Council opened a public <br /> hearing to review evidence and receive testimony related to Use Permit <br /> revocation proceedings for the Taco Bell restaurant located at 910 <br /> Woodside Road. This item came to your Council in the form of a <br /> Recommendation by the Zoning Administrator pursuant to the <br /> procedures outlined in Section 42.9 of the Zoning Ordinance related to <br /> Revocation Proceedings. <br /> As evidenced by the video taken by the adjacent residents as well as an <br /> attached petition from neighbors complaining about the recurrent noise, <br /> traffic and loitering-related problems, the impacts of this commercial use <br /> on the adjacent residential units are serious. <br /> Although there exist remedies to address these types of nuisances, staff <br /> strongly feels that their effectiveness will rely mainly on the continued <br /> vigilance and social "awareness" of the Taco Bell chain, which includes <br /> their managers, restaurant operators and security guards. <br /> Substantial time and effort have been expended by both City Planning and <br /> Police staff in order to clearly identify the issues and seek ways to mitigate <br /> related impacts to the neighborhood caused by the subject Taco Bell <br /> restaurant operation. <br /> Page 1 <br /> --------- <br /> . <br /> ì n______--"'--.--------T------- ------- <br />
