<br /> [ <br /> the tolerance level of neighboring residents located along Woodside <br /> Road and Union A venue has reached a threshold point. Long term <br /> improvements need to be made if the restaurant is to continue its <br /> current operation. <br /> BACKGROUND: Records at the Planning Division indicate that the Planning <br /> Commission reviewed an Initial Study for the construction of a Taco Bell <br /> restaurant at 910 Woodside Road in May of 1981. Although noise, traffic, <br /> as well as trash pickup and lighting impacts were noted as major concerns, <br /> staff made a determination that the probable environmental impacts of <br /> the restaurant, if mitigated accordingly, would be potentially insignificant <br /> to the surrounding area. A Negative Declaration was certified. A second <br /> public hearing was subsequently held before the Zoning Administrator to <br /> address Taco Bell's Use Permit application. No drive-through could be <br /> accommodated due to the narrow, single-frontage configuration of the lot. <br /> The site was originally zoned "CG" (General Commercial) District, which <br /> requires a Use Permit for restaurants. In 1993, this section of Woodside <br /> Road was rezoned to "CG-R" (General Commercial--Residential <br /> Combining) District to better reflect the mixed use characteristics of the <br /> area, which includes the 75-unit apartment building located immediately <br /> adjacent to the west of the Taco Bell parking lot. Several conditions <br /> involving traffic safety, trash service and related noise control measures, <br /> -' as well as provisions regulating the exterior appearance of the proposed <br /> restaurant, were attached to Taco Bell's Conditional Use Permit. <br /> Over the past several months, both Police and Planning staff have <br /> received an inordinate number of calls from adjacent residents <br /> complaining about Taco Bell's Woodside Road operation (see attached <br /> Police Report). Residents generally complain about noise, traffic and <br /> loitering. These problems tend to occur at night and generally involve <br /> youths who come by car. <br /> Since May of 1993, per direction of your Council, staff has been working <br /> closely with both Taco Bell and neighboring residents in order to foster a <br /> workable action plan for both parties. Since that time, staff has held <br /> several meetings with Taco Bell's local, regional, and construction <br /> managers, as well as their corporate attorney. The property owner, and the <br /> managers and residents of the adjoining apartment building have also <br /> been invited to communicate their concerns and perceptions to staff. In <br /> late July of this year a twelve point program was subsequently agreed upon <br /> by both parties with the understanding that the remediation steps taken by <br /> the restaurant operation would be evaluated within 30 days (see attached). <br /> The Peninsula Conflict Resolution Center was invited to monitor and <br /> ~ record all testimony taken at the September 23, 1993, public hearing (see <br /> attached records) and to help analyze the situation.
