<br />T <br />I <br />I <br />I <br />I <br /> <br />R E P 0 R T TO THE HONOIAME <br /> <br />MAYOR AND CITY COUNCIL <br /> <br />NOM '"I CITY MANAOII <br /> <br />DATE: November 1, 1993 <br /> <br />SUBJECT: Findings and Recommendations of the Zoning Administrator <br />pursuant to Section 42.9 of the Zoning Ordinance regarding <br />Revocation Procedures to modify and/ or impose new conditions <br />in lieu of Taco Bell's Use Permit at 910 Woodside Road. <br /> <br /> <br />RECOMMENDATION: It is recommended that the City Council hold a public <br />hearing after giving 10 days notice to the permittee, to review the findings <br />and recommendations of the Zoning Administrator and impose new <br />conditions to Taco Bell's Use Permit. <br /> <br />INTRODUCTION: Use Permit revocation proceedings are rare and generally <br />indicate a serious discrepancy between the original City permit approvals <br />and the actual on-site situation. This process allows existing use permits <br />to be reevaluated by the City in light of new information, regulations <br />and/ or policies affecting the subject use. <br /> <br />Over the past several months, the City has received an increasing <br />number of complaints from citizens residing next to the Taco Bell <br />restaurant located at 910 Woodside Road. Neighbors strongly object to <br />the current Taco Bell operation, referring to its detrimental impact on <br />their health, safety and welfare, and pointing to the restaurant operator's <br />apparent lack of concern about their livelihood. <br /> <br />Both Police and Planning staff have joined efforts to assist Taco Bell in <br />finding ways to control the recurrent noise, traffic, and loitering <br />problems which are generated by groups of youths patronizing the <br />restaurant. This situation does not appear to be specific to Woodside <br />Road, since the Taco Bell restaurant located at the intersection of <br />£1 Camino Real and James Avenue has prompted Taco Bell to work out <br />an enforcement program with both the Redwood City Police Department <br />and Sequoia High School administration. Nor are these issues related <br />exclusively to Redwood City, since other municipalities such as Santa <br />Clara and San Jose have had to deal with considerably more difficult I <br />issues. Therefore, there is an apparent need for the Taco Bell chain to <br />seek better ways to control, and ideally eliminate, the negative impacts I <br />caused by their operations (see attached articl~).
