Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> 718 Canyon Road and 761, 763, and 765 thin Place, Redwood City, CA 94064 <br /> H S I PROVEMENT AGREEMENT ("Agreement") is made and entered into on tbi2- day <br /> of , 20 ("Effective Date") by and between by and between Ernst Develo ment <br /> Corpo ation, a California'C,Gorporation ("Developer"), and the CITY OF REDWOOD CITY, a <br /> charter city and California municipal corporation ("City") with reference to the following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting of <br /> approximately 0.80 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B. On January 17, 2006, the Planning Commission of the City of Redwood City approved a <br /> Tentative Parcel Map 2005-08 for 718 Canyon Road and 761 , 763, and 765 Bain Place ("Project"), <br /> prepared by MacLeod and Associates, Inc. and dated October, 2005 ("Tentative Map"), subject to certain <br /> conditions of approval ("Conditions"). <br /> C. The Conditions require either (1 ) that certain public improvements for the Project be <br /> constructed prior to approval of the parcel map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled 718 Canyon <br /> Road Improvement Plans, prepared by MacLeod and Associates, and dated January 30, 2014 the <br /> `Improvement Plans"), which, in addition to other improvements, provide for certain on-site public <br /> improvements consisting of street and street light improvements, storm drain systems, domestic water <br /> systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br /> F. Upon approval and recordation of the Final Map, the Property will be divided into four <br /> residential lots hereinafter referred to as the "Residential Parcels". <br /> G.
