<br />Police Chief Guardino to the Council Members. Councilwoman Steinfeld stated <br />her opinions on the need to enforce speed and safety laws consistently, how <br />venting meetings should be held, what public meetings Council Members should <br />or should not attend, and what should or should not be held confidential. <br />Councilwoman Steinfeld stated she had seven points she wished to make: 1) <br />The subject memo was incorrectly marked confidential; 2) the article quotes <br />certain lawmakers who fear Joe Steinfeld may circulate confidential <br />material that could jeopardize lawsuits or labor negotiations, and she <br />stated that action cannot be taken because a person fears the law MAY be <br />broken; Councilwoman Steinfeld stated that "both Joe and I have been <br />accused by a number of people including our Mayor of excessive use of <br />litigation and attorneys" and "we will continue to consult qualified legal <br />opinion as well as resisting any effort at the denial of our rights because <br />of what someone thinks may happen in the future; 4) suggested that her <br />colleagues contact Mr. Terry Frank, chosen by the State Senate to rewrite <br />the Brown Act, who has advised that the confidential status of the subject <br />memo was not justified; 5) referred to Mr. Everett's quote in the newspaper <br />article regarding proper channels through the City Attorney's office, and <br />how she had tried to have the City Attorney respond to her requests for a <br />retraction of the claims he made in his October 21st letter about her <br />conduct at a Council meeting; 6) referred to what should or should not be <br />confidential responses to public letters, and not based on what is <br />embarrassing but what is legitimately confidential; 7) "I do not agree that <br />Joe and I gave conflicting accounts, the memo never had grounds for <br />confidentiality." Councilwoman Steinfeld stated she had not even seen the <br />document. until after the meeting on December 29, 1993. Councilwoman <br />Steinfeld addressed Councilman Greenalch and asked what he meant by his <br />quote in the newspaper, "I've been told that to share that kind of <br />confidential documentation is no violation of the l&w, but in my opinion <br />it is a violation of a public trust." Councilwoman Steinfeld stated she was <br />not elected to the Council lito hide information from the public, to avoid <br />the public, to engage in ever increasing violations of the Brown Act, or <br />ever broadening exclusions of people from participation in public hearing, <br />it is the illegal and unwarranted secrecy that to my mind is a violation of <br />the public trust." Councilwoman Steinfeld suggested that no more materials <br />be stamped confidential unless the City Attorney approves the designation of <br />confidential. Councilwoman Steinfeld added that the subject memo did not <br />fall into any confidential category that was outlined by the City Attorney <br />at the time of orientation for new Council Members. <br /> MEMO 1/25/94 <br />Councilman Greenalch stated III choose not to respond to everything until I <br />have it in writing. I think there is an important distinction between the <br />law and what is ethically correct behavior. I am not making any <br />accusations. I was asked a direct question, 'did I think that Councilwoman <br />Steinfeld would ever share confidential information that would be <br />detrimental to the City of Redwood City and my answer was NO'. That does <br />not appear in the article. But the common courtesy of calling someone and <br />asking them, the same type of behavior that you said you found <br />inappropriate, I, Councilwoman Steinfeld, also find very inappropriate this <br />evening."
