<br />RESOLUTION NO. 12124 RECOMMENDING INCLUSION OF THE SEQUOIA HIGH SCHOOL <br />CAMPUS, A LOCAL HISTORIC LANDMARK LOCATED AT 1201 BREWSTER AVENUE AND 480 <br />JAMES AVENUE IN THE CITY OF REDWOOD CITY, ON THE NATIONAL REGISTER OF <br />HISTORIC PLACES <br />ADOPTED BY UNANIMOUS ROLL CALL VOTE. <br />---------------------------------------------------------------------------------- <br />4. WRITTEN COMMUNICATIONS <br />None. <br />---------------------------------------------------------------------------------- <br />5. BOARD, COMMISSION AND COMMITTEE REPORTS <br />A. Report of the Personnel Committee Regarding the Current Council Inquiry <br />(301-08) <br />Councilman Greenalch introduced Mr. James Jackson, the legal counsel <br />the Council authorized the Personnel Committee to retain, who took a <br />chair next to City Attorney Schricker at the dais. Councilman Greenalch <br />advised that the Personnel Committee looking into alleged behaviors on <br />the part of two colleagues on the City Council was making a <br />recommendation that the Council authorize the issuance of subpoenas to <br />the Great Western Bank, its officers, employees or agents. The purpose <br />of the recommendation was to obtain the one last critical piece of <br />information that was necessary for the investigative committee to <br />receive; and it was from Great Western Bank, who had made it clear they <br />are not in nor will they be in, a position to present any information <br />that they might have unless they are asked to do so under a subpoena. <br />Council does have the power to issue subpoenas and those subpoenas carry <br />the full weight and force of the law. Further, if the persons or <br />institutions to whom the subpoenas are issued, refuse to comply with the <br />subpoenas, this matter is called to the attention of the Superior Court <br />and the Court involves itself and compels compliance with the subpoenas. <br />In asking for these subpoenas no one should interpret it or prejudge what <br />shall or shall not be discovered. The committee is simply asking for the <br />authority because the committee has reason to believe that Great Western <br />Bank, its officers, employees or agents, may be in possession of <br />information that will be germane to the conducting and conclusion of a <br />fair, objective investigation with Findings to be presented to the City <br />Counci 1. <br />Councilwoman Steinfeld asked Mr. Jackson to what extent will the records <br />of Great Western be subpoenaed? Councilwoman Steinfeld stated it was <br />none of the business of this Councilor any other legislative body as to <br />the assets she held in Great Western or any other institution. Mr. <br />Jackson advised "it's not that kind of an investigation." Councilwoman <br />Steinfeld asked, "if a statement was made that I will pull my accounts <br />from your bank, that is not relevant to the investigation, is that not <br />correct?" Mr. Jackson stated "that's a different issue" and added that it <br />could be relevant.
