Mr. Morgan stated that certain due process rights that would attach to a disciplinary hearing
would not attach to these proceedings, because it was not a disciplinary hearing. Therefore the
decision reached would be extrajudicial and it would be of "no moment" whether certain Council
Members recused themselves from the discussion and decision or not. Any decision will be a
political decision. It may be within ethical constraints, he conceded, but it would at the base of it,
be a political decision because the Council is a political body. Mr. Morgan stated he did not use
the word political in a pejorative sense.
RESTATEMENT OF THE MOTION WITH CLARIFICATIONS
MIS: GREENALCHICLAIRE THAT THE COUNCIL DENY COUNCIL WOMAN
STEINFELD, AS AN INDIVIDUAL COUNCIL MEMBER, THE RIGHT TO USE THE
SUBPOENA POWER OF THE REDWOOD CITY COUNCIL, DENY THE REQUEST TO
HAVE A QUALIFIED INDEPENDENT REFEREE TO CONDUCT THE HEARING AND
LISTEN TO AGREEMENTS ON THE RELEV ANCE AND ADMISSIBILITY OF TESTIMONY
AND EVIDENCE, AND DENY THE REQUESTS IN HER LETTER OF MARCH 22, 1994 TO
JAMES P. JACKSON (WHICH PERTAINED TO THE FIRST REPORT AND WAS NO
LONGER UNDER CONSIDERATION)
Council Members discussed the rights retained which were the right to her own attorney and the
right to present evidence; but no further discussion of the first report would be considered or
allowed at any time.
CARRIED BY UNANIMOUS VOICE VOTE WITH COUNCIL WOMAN STEINFELD
ABSTAINING.
MINUTE ORDER NO. 94-92
Mr. Morgan renewed his request for continuance.
MIS: GREENALCHICLAIRE TO CONTINUE THE MATTER TO MONDAY, APRIL 4,
1994, AND GRANT NO FURTHER CONTINUANCES BEYOND THAT DATE
THE MOTION FAILED ON THE FOLLOWING ROLL CALL VOTE:
AYES: COUNCIL MEMBERS CLAIRE AND GREENALCH
NOES: COUNCIL MEMBERS GASPARINI, LA BERGE, SANFILIPO AND
MAYOR BUCHAN
ABSTENTIONS: COUNCILWOMAN STEINFELD
MINUTE ORDER NO. 94-93
Mr. Morgan stated he had, in anticipation of the denial of his request for a continuance, advised
Councilwoman Steinfeld not to participate any further in the proceedings, and to leave the
Meeting at this point. Mr. Morgan stated he regretted this course, but he was completely unable
to defend her under the circumstances, and he elected not to dignify the proceedings with her
continued presence.
MINUTE BOOK NO. 52
Page No. 196 Regular Meeting Minutes
March 28, 1994
Page 12
