El Camino Real (State Route 82) is a major thoroughfare <br /> traversing the City in a generally northerly/southerly direction, <br /> which intersects approximately three blocks northerlv from the <br /> Property with Woodside Road (State Route 84) another major <br /> thoroughfare traversing the City in a generally easterly/westerly <br /> direction. <br /> 4. Appellant applied for a modification to the existing use <br /> permit to allow entertainment, in the form of dancing accompanied <br /> by a~plified music, in conjunction with which the operating hours <br /> of Appellant's establishment would be extended to 2:30 a.m. <br /> Appellant's application was heard by the Zoning Administrator at <br /> a public hearing on March 15, 1995, subsequent to which, on April <br /> 5, 1995, the Zoning Administrator denied the application upon <br /> stated findings (Deterl"..ination of Zoning Administrator, April 5, <br /> 1995). Timely appeal was taken by Appellant (Letter of Appeal <br /> dated April 12, 1995). <br /> 5. On appeal, Appellant proposed to modify the operating <br /> hours pertaining to the entertainment/ dancing use by providing <br /> for a closing time of 1 a.m. instead of 2:30 a.m. (Letter of <br /> Appeal dated April 12, 1995). Further, Appellant proffered a <br /> proposed plan of operation which would provide for varying types <br /> of entertainment relating to style of music and/or patronage <br /> (viz., "Senior Night, " "Country and Western, " "Top-Forty" i see, <br /> plan of operation entitled, "R.C. Savoy's House of Buffet," page <br /> 3). Appellant's proposed operation contemplates use of valet <br /> parking to allow for more intensive use of Appellant's existing <br /> on-site parking lot (id. at page 4). <br /> 6. The Property is located in an area which, in the past, <br /> has been notorious for its activities involving prostitution and <br /> drug trafficking. A neighborhood association comprised of <br /> residents and business operators in the vicinity of the Property <br /> has worked in conjunction with City personnel, including the <br /> Police Department, to improve living conditions relating to the <br /> residential areas surrounding the Property. Such efforts have <br /> included the establishment of a drug-free zone in a neighborhood <br /> park in the vicinity of the Property, and aggressive prosecution <br /> of offenses relating to drug trafficking, and alcohol abuse. <br /> 7. In or about 1988, when the Property was owned by a <br /> predecessor in interest to Appellant, a dance permit had been <br /> issued by the Police Department for use in conjunction with a <br /> t.hen-existing restaurant. During the one-year period involved, <br /> the Police Department received some twenty-nine calls for service <br /> relatinq solely to the Property including offenses involving <br /> drugs, alcohol, disturbance of the peace, and prostitution. <br /> I <br /> -, _. <br />
