<br /> John Mooney, Pleasant Hill Road, Redwood City, stated it was premature to develop <br /> a Specific Plan for this site, and he was concerned about the Redevelopment Agency <br /> Board taking private property and giving it to another private owner. <br /> Carol Middlesteadt, Attorney for Mrs. Rosalie Davies, advised Council that on June <br /> 21, 1994 a judgment of court awarded this property to Mrs. Davies as the sole owner <br /> and the judgment has been recorded. Ms. Middlesteadt advised, however, that post <br /> judgment proceedings were continuing. Mrs. Middlesteadt stated that her client was <br /> deeply involved in litigation and not able to focus on this matter at this time; and, she <br /> believed it was premature for the Council to approve this Specific Site Plan. <br /> In response to Councilman Greenalch's questions, City Attorney Schricker advised <br /> that adoption of a Specific Site Plan should be considered solely under the planning <br /> laws of the state of California and totally irrespective of who owns the property. <br /> In response to Councilman Greenalch's questions, Attorney Middlesteadt advised that <br /> in her opinion the judgment of court was not a change of ownership and on behalf of <br /> her client, Rosalie Davies, she would strongly object if the Council attempted to deem <br /> it as such. <br /> Council Members discussed consequences of change of ownership, decisions made <br /> within the context of future plans and ownership; and intent of the Specific Site Plan. <br /> John Holt, Iris Street, told Council not to take private property for someone else's <br /> benefit. <br /> John Mooney, Pleasant Hill Road, expressed concern regarding the Specific Site Plan <br /> limitations on private property and property values, and asked Council to table this <br /> Plan for the time being. <br /> Councilman Greenalch quoted Minute Order No. RD93-023, from the <br /> Redevelopment Agency Meeting of October 25, 1993: "MIS: CLAIREILA BERGE TO <br /> APPROVE OPTION 2, INTEGRATE THE SITE INTO SEQUOIA STATION BUT DIRECT STAFF <br /> TO DO EVERYTHING POSSIBLE TO ENSURE THAT THE BUSINESS IS RELOCATED IN <br /> REDWOOD CITY. IF IT PROVES IMPOSSIBLE TO RELOCATE THE BUSINESS, THE BOARD <br /> MAY WISH TO RE-EV ALUA TE ITS POSITION AND CONSIDER ONE OF THE OTHER <br /> OPTIONS'; AND, INCLUDE THE POSSIBILITY OF LOCATING THE DEALERSHIP ON THE <br /> SAME SITE IF THE BUSINESS AND OWNER WISH TO PARTICIPATE WITH THE CITY IN A <br /> PARTICIPATION AGREEMENT; AND THE BOARD TO SET A FURTHER DATE TO RE- <br /> EVALUATE ITS POSITION AFTER THE SPECIFIC PLAN HAS BEEN FORMULATED." <br /> In answer to Councilman Greenalch's questions regarding additional information <br /> needed, City Manager Everett advised that negotiations were well under way <br /> between Sequoia Station Developer David Irmer and the parties in questions according <br /> to the Board's directions. Mr. Everett advised that staff was not involved in the <br /> negotiations and would not be able to provide further information until the private <br /> negotiations were concluded.
