<br /> Zoning Administrator <br /> City of Redwood City <br /> 1017 Middlefie1d Road <br /> Redwood City, CA 94063 <br /> Re: Findings on Appeal of Zoning Administrator's Issuance of Variance <br /> Permitting Encroachment of Handicap Ramp Into Required Side Yard, and <br /> Permitting Excess Deck Elevation At 815 Canyon Road, Redwood City, <br /> California <br /> Hearing having been duly noticed and held by this Council on July 11, 1994, on <br /> the appeal of Mr. and Mrs. Umberto Bagnarol ("Appellants") of the decision of the Zoning <br /> Administrator to approve the application of Ms. Eva Kolesnikow ("Applicant"), for a <br /> variance to allow the construction of a deck and handicap ramp within the required side <br /> yard setback of property located at 815 Canyon Road, Redwood City, California, (the <br /> "Property"), the Appellant, the Applicant, the Zoning Administrator, and all other persons <br /> interested in the matter having been heard and having been given the opportunity to be <br /> heard, and this Council having fully considered the matter; <br /> NOW, THEREFORE, this Council hereby finds, concludes and orders as follows: <br /> FINDINGS <br /> 1. The Property is located in the R-l (Residential-Single Family) Zoning district <br /> (S5.1 et seq., Ordinance No. 1130, as amended, the Zoning Ordinance ofthe City of <br /> Redwood City [all section references herein are to said ordinance unless otherwise <br /> indicated]). <br /> 2. Applicant applied for variances to the provisions of Section 32.3.a(4) <br /> (Supplemental Side Yard Requirements) to allow the construction of a handicap ramp <br /> within the required 6-foot side yard (S5.9a(2» and to the provisions of Section 32.11 <br /> (Construction in Yards) to allow construction of decking within said side yard, the <br /> elevation of which exceeds one (1) foot as to a portion thereof. Said application was <br /> granted by the Zoning Administrator after hearing thereon on May 25, 1994. <br /> The variance, as granted, permits the construction of a deck exceeding the <br /> limitations of Section 32.11d, to wit: in excess of one foot above finished grade. Said <br /> variance was granted upon the apparent finding that the deck constructed at the Property <br /> conformed, at least in part, to the requirements of Section 32.11 d, but exceeded the one <br /> (I)-foot limitation as to portions thereof. <br /> The variance also permits the construction of a handicap ramp extending from <br /> newly constructed French doors in the side of the residential building located on the <br /> Property into the required side yard beyond the permitted encroachment under Section <br /> 32.3a(4), to wit: in excess ofthree feet. <br /> MINUTE BOOK NO. 52 <br /> Regular Meeting Minutes Page No. 341 <br /> August 1, 1994 <br /> Page 7 <br /> -"-."- ,- ""-'~~'---'---""'--"--""'"-"-'"-""'--""--'---' <br />
